Confirmation from Glasgow Sherriff Court - 10/12 weeks?

Application for Confirmation going in soon but our solicitor is saying that Glasgow Sherriff Court has a 10 to 12 week delay for gaining confirmation. Sounds rather long. Is that normal?

    That sounds very long. We submitted our confirmation and it was approved in a couple of days. We did the form ourselves and granted it was to Tayside sheriffdom but was a very easy process. 

    Hopefully it doesn't take you 12 weeks.

    I'd expected maybe 4 or 5 weeks but 10 to 12 sounds ridiculous.

    Unfortunately your solicitor might be correct.  Although most Courts do have a quick turnaround, others do take a lot longer.  Bear in mind that Glasgow is one of the busiest Courts in Scotland and they likely have a huge volume of applications to check and process daily.  Hopefully your solicitor is over-estimating the timescale and this might take into account if your application has to be returned for any reason but I wouldn't be at all surprised if the estimate is mostly accurate.

    Pity we can't just choose a less busy court but I assume it has to be the one where the deceased lived?

    I assume it has to be the one where the deceased lived?
    Correct, you can't shop around. Same principle as any other type of court business.

    Unlike some other court processes this doesn't have any particular deadline, so the timescales depend on the staff available and their backlog.

    Hello- I submitted in January in Glasgow - still waiting after 11 weeks (and relatively straightforward case) so unfortunately I feel thats probably correct. Thought I would let you know so you can mentally prepare, because it is draining to wait

    Thanks. The solicitor said she still had one waiting from November. Every time they phone about it they’re told it will be sent out shortly but never happens. She has no idea why it’s so bad just now as it wasn’t even this bad during Covid!  Last July it was 4 weeks. 

    I wouldn’t mind the wait so much if there wasn’t a house to sell. We have Confirmation for half of it but not a lot of use. Meanwhile we still have bills to pay from the estate.

    Sounds like they've lost staff, perhaps the more experienced staff?

    Quite probably. They should get more staff then and clear the backlog.
