Lex Autolease didnt collect car on date specified and want to add charges

Hi all, first post here

My wife's car was being collected, but collection company cancelled on the morning of pickup.  They trued to pick it up a week later and the battery was flat.  We spoke to LEX who advised taking it to a garage which we did.  The garage fitted a new battery and we advised LEX it needed picking up as MOT would run out within 5 days.  The collection company couldnt get there for another week so we spoke to LEX who advised to MOT the vehicle and claim back 

The vehicle was collected and we raised a complaint.  They have reviewed the complaint and said we cannot get the money back for the battery (£150) or the MOT and they have also sent a bill for £300 for contract extension!

The complaints team have said its been reviewed and we can go the financial ombudsman if we want 

We have asked for a subject access request as the LEX employee advised that we could pay for the above and get reimbursed

Just wondering what we do from here?

    Make a mental note to ensure that, next time, the car is able to be collected as arranged.

    This is not Lex's fault. Their collection company tried to collect it, but it could not be driven because of the condition you had allowed it to get into. The delays beyond that point arose solely because of that condition.

    Thanks but the didnt collect it on the arranged day, they cancelled last minute due to staffing issues.  Hence the car was up our path for a week unused

    Send the £300 bill back stating car was ready for collection, as contracted, on pre-arranged, agreed date. Also send them a bill for the MOT as this was Lex who requested that this course be taken.

    I'm not sure why you couldn't just jump start the vehicle (I'm sure it's something the collection people.would have need to do before)
    Definitely refuse to.pay the additional rental. You may struggle to get the MOT and battery back as really you should have refused to do that, but worth a try.

    Yes, you said. Then, when they did, it couldn't be collected because the battery was flat...

    Leaving a car unused for just one week will not flatten a healthy battery.

    Letter Before Action then Small Claims Court

    As said before I doubt you will be able to recover the cost of a battery.
    How long passed between when the car was last used and when it was due to be collected?

    Check your agreement regards who was responsible for the MOT but i fear they will say by not allowing it to be collected that it is your error

    your currently down £450
    add on the cost of £50 for the court fee
    plus the amount of time it is going to cost you, you need to weigh up whether it is worth investing into recovering that money

    I know its £450 but say they dispute 6 months minimum before you can get to a court and even then, there's no guarantee you will win

    personally i would give up but wish you best in your endeavours

    Thanks, it's the £300 extra for the car theyre charging because they couldnt collect it on the original date and when they turned up a week later it was flat.  If they'd took it on the correct day none of the above would have happened.  

    The LEX rep on the phone agreed it wasnt our fault and said if we pay for the battery / garage and MOT we should get reimbursed ..  We have requested a SAR on the phone calls made

    But if you'd taken care of the car properly while it was still in your possession, it would have started when they tried to collect it.
