DCAs on business vehicles

Can anybody explain why it is fair that undisclosed discretionary commission can be claimed for on private vehicles, but not on business vehicle purchases?  We have one private vehicle DCA claim on hold - which we will probably have to fight because the repayments are paid directly from our self employed business account, but are treated in our accounts as drawings - but we have other vehicles purchased on HP for the business which, more than likely, have had DCAs in place but against which we cannot made any claim.

    For the same reasons that business are not covered by the Consumer Credit Act, the Consumer Rights Act, Consumer Contract Regulations etc etc etc. As a business you are expected to know if/when you need access to a lawyer, have the resources to do so and be able to make serious decisions without them if you decide not to engage one.

    Consumers are considered in need of being protected from businesses and themselves hence have many more statutory rights than other businesses. 

    Personally find it slightly peculiar that a dumb !!!!!! student has all these protections and yet they setup a website tomorrow to promote themselves as a life coach and suddenly they are supposed to understand the law and know to engage professionals where they dont know. However I think the nanny state goes too far and consumer protections should be reduced which would reduce the price of goods for those of us able to look after ourselves. 
  • Thank you - clear and concise.  Always find it a bit of a pain that self employed businesses (little more than a consumer wanting to earn a living!) are lumped into the same category as large companies for so many things.  We come across this all the time and have to comply with stuff that's really aimed at the big boys.  With the DCA of course, the issue is that they were undisclosed so that even the aforementioned 'big boys' would not have known either.  Ah well, life's a b.... and then you die!
