I am preparing my defence against ECP who are represented by DCB legal, I am using the defence template and advice on the forum but would be interested in peoples opinion on these details.
I parked there ion the evening of 22/01/23 to attend an event of three hours duration, it was dark and the sign was confusing.
The machine would not issue a ticket for £3.50 which was the evening tariff, I have some anecdotal evidence of this happening to other people - would this be relevant?
After multiple attempts I got a ticket - paid for by credit card - which was for £1.60 only an hour I realised later, but the ticket does not indicate how much has been paid. But obviously why would I not pay for the correct amount knowing that I would be there for at least three hours?
When I looked at the ticket issued(see photo) it has expiry date as17:03. As it is a car park you can stay in for 24hours I assumed it was a problem with the machine - is this relevant?
Finally there are lots of reviews on the web about people receiving unjustified penalties in this car park

Faulty machines are always relevant, especially in your Witness statement later this year, briefly mention it as paragraph 3,1
Presumably the issue date is incorrect in the POC, so please post a redacted picture of the POC details after redacting your VRM details first
Post the Issue date from the claim form and the date that you did the AOS online too
Use the Shahib_02 defence, adapted as required in paragraph 2 & 32 -

Also I looked for the Shahib_02 defence and couldn't find it0 -

The issue date on the POC is correct but if you look at the parking ticket 17:03 is directly under the expiry date which is what caused me to think the machine wasn't working properly. But again retrospectively 17:03 is the time at which I purchased the ticket. It also has 1.60 on it - the amount paid but no indication that it is.
Claim form issue date 21 Feb
AOS online form submitted 7/03/25, accepted 10/03/250 -
If a windscreen PCN was issued on 22 January, to the vehicle on the incident date, then yes it may be correct, but the Shahib_02 defence is based on the issue date being the later postal PCN letter
Your deadline date for the defence is 4pm on 26th March2 -

Finally there are lots of reviews on the web about people receiving unjustified penalties in this car parkNo, you are quite rightly confused here as the ticket format is not conforming to the machine printing format:17:03 is not a date format it is clearly the time of entry which has been printed in the date placeholder.It follows that 17:03 to 18:03 shows you paid for an hour.I suspect that evening tariff likely begins at 18:00 which is why that wasn't offered at the time.So at 17:03 you would need to pay for the three hours.But that does not alter the fact that it is confusing and the ticket issued is not fit for purpose.3 -
The evening ticket start time is 16:30 as shown on the photo of the sign provided by ECP1

So the Shahib defence is based on the fact that the PCN issue date on the original notice is different to the one on the POC?0
