Ran off road by Truck

If you didn't make contact with the truck at all, then their insurance will simply say "our insured vehicle was not involved", and refuse the claim.Hollybear said:Hi all, Need some advice. I was driving on the road, going around the bend and I came upon a Scania Truck that was in the process of overtaking. The truck was on my side of the road and I had to swerve the vehicle to avoid a head on collision. This resulted in my vehicle hitting into a verge which caused the damage to my car. Should I contact the truck's insurance? Thanks
End of.
If it was just your vehicle + scenery, then it's your insurance or nothing.

One can be involved without making contact.Mildly_Miffed said:

The Road Traffic Act 1988 defines an accident as "owing to the presence of a mechanically propelled vehicle on a road ", i.e. no collision is necessary.
If there is dashcam or other evidence to support the OP's account, then it will be difficult for the TP insurer to deny that the accident was "owing to the presence" of their insured's truck.0
