    @GDB2222 I'd ring up EDF and raise a Formal Complaint about them not having credited your account £40 for failed appointment and quote that paragraph at them if they try to be funny. If they still don't pay up, you can go to the Ombudsman after 8 weeks.

    I’ve just written a letter before action. I’ll give them a chance to respond and just issue proceedings through MCOL. It’s far less complicated than complaining to someone who has no idea about the regulations and then repeating the whole thing to the ombudsman. 



    I don't think the courts will look favourably upon you not following the complaints process in full.
    In practice, this won’t come before a judge. Either someone with half a brain cell at EDF will look at it, and realise there’s no defence. Or, they will ignore the proceedings and lose by default. 
    I think you might be over thinking things there, the compensation system for the £40 is not going to be a slam dunk as it is tied to the complaints procedure which also means you are supposed to complain via the ombudsman. Based on what you have said EDF may well defend and and the judge will throw your claim out.

    Your annoyance seems to be excessive. If you prodded them they will almost certainly pay it, you can simultaneously prod them for more as they did not pay it in the correct timeframe, they may well add a small amount of "shut up and go away" money on top. That makes far more sense than trying to go nuclear straight away.
    I phoned them up, as you suggested, and spoke to a nice lady who promised to pass a message to the right department.

    So, let's see whether they do send the money through.
