ANPR fault – how to prove it and avoid charge

    There is another angle ,  potentially could obtain  undeniable evidence,  if  the driver  visited   a different private  car park between the times alleged  . 

    This could be popping into Tescos or its petrol station etc  ? .   A SAR to those operators managing those respective sites - request a full Anpr log on that day ( partially redacted apart from your own. ) 

    If the above is applicable to you - then you will probably need to do this immediately if your appeal avenue are exhausted.

    Thank you @Car1980 @Bazariusfor your comments. I have now submitted an appeal to Total Parking Solutions based on the suggestions from the forumites and the wording suggested by the landowner itself (who said this PCN would not stand, I quoted their response in the appeal letter). Unfortunately, two neighbours with video doorbells or cameras could not support my appeal as they either did not capture the car (due to the angle of the camera) or their equipment failed (one neighbour needs to repair - they were not even aware it was not working until I asked). I had no visits to Tesco (would have used receipt as a proof of location) or petrol stations during gthe period in question, unfortunately. I will wait to hear what TPS say - the landownder told me to come back to them in case of unsatisfactory appeal (and yet refused to cancel PCN).

    I am still waiting for the outcome of my appeal to TPS, but in the meantime I would appreciate forumites’ advice on how to get TPS more accountable for ANPR faults. I raised the issues about the unreliability of ANPR systems with my Union and employer, stressing that members were fined inappropriately for the non-existent parking violations (double dipping) and this affected their conditions of work. I also tried to find out how to stop continuous breaches of GDPR legislation each time such an erroneous parking claim is made. I stressed that many people simply accepted and paid PCN as it was easier. I wanted to establish how many people in my workplace were affected by the same ANPR issues, and how the employer supported them. I also asked if any changes have been made to avoid double dipping (such as manual checks, foot patrols, additional monitoring equipment to take back up images, etc.).

     

    Prompted by the union, the employer met with TPS, who is acting on employers behalf, to review ANPR usage. According to their data, ANPR problems (such as double dipping) over the last 6 months led to only 3 successful appeals (no data on how many appeals were unsuccessful and on how many occasions ANPR issues were actually identified). It was stated that TPS would not release their data due to commercial interests. I was told that TPS would undertake the efficiency review of cameras – without mentioning what this would involve. I was also told that the employer were not aware of any specific concerns regarding GDPR regulations and GDPR would have been fully considered as part of the procurement process and agreed as part of the contract.

     

    I am unhappy about the fact that the employer did not actually address the questions I asked, aimed at avoiding ANPR use and its known faults. None of the specific solutions (manual checks, foot patrols, additional monitoring equipment) were mentioned, and no data on how many ANPR faults led to PCN issuing were given. GDPR violation has simply been ignored – despite the fact that every time the erroneous PCN issues issued the driver’s data is accessed for no justifiable reason. I have considered Freedom of Information request, but it has been parked for now.

     

    I would be grateful if you @Half-way @KeithP @fisherjim @Coupon-mad @Sloppyjoe @Nellymoser @Fruitcake @Umkomaas can help me to draft a letter to the Union and my employer that can help to address these issues and prompt specific actions on the part of TPS. The Union are very helpful, I am just trying to find the right wording to express my concerns.

    Telling us there were only 3 successful appeals is really helpful not! How many unsuccessful appeals were there and how were they discriminated?

    I can only assume the "Commercial Interest" is the very real risk that their golden goose would be cooked!
