Wrong reg pcn County Court Claim

I bought a private parking ticket (which I still have) in June 2024. Unfortunately, I accidentally put in the machine my car reg rather than the one I was in (borrowing car as mine was in the garage). I am insured on this car.

I got sent pcn...I appealled and offered £20 admin fee but this was declined. They said they are not part of BPA. Company is Armtrac. I actually in the same week did same scenario in a different car park but they let me off with a £20 admin fee I felt fair. I didn't think £60 for this one was fair as that is 2,900% more than what I actually paid to park. Now they want £245! Bandits.

I have ignored the threatening emails, letters and phone calls that have escalated costs.

Now been sent a County Court Claim. I only knew through bw legal I'd been sent one as I didn't receive one in the post? Bw legal the claim was issued 13th Feb.  I called HMCTS Civil Contact Money Claims Service (took 1 hour 42 mins to answer)...thank God for speaker phone. They said they had posted it on 18th Feb...but won't repost...did text me some forms but have no info who to send them to?

I am planning on defending claim, happy to pay what I offered before...£20 admin fee.

I guess I need to acknowledge the claim...my claim number won't work online though? It worked over the phone ...hm government online civil money claim service.

Then I need to place a defence...I realise I need to look up the newbie thread and read up on this.

I suppose I'm a bit overwhelmed as I haven't got the pack to help me from the court, and I'm worried I can't find out how to acknowledge the claim. Then I just hope using this website and any help from anyone here I can put a decent defence together.

Any help with any of the above appreciated.

    Login to the government gateway first,  then navigate to MCOL and you need the claim reference plus the password from the missing claim form pack that hasn't arrived , presumably issued on 13th February,  so 

    I hope that you asked the CNBC to email a copy of the front of the claim form   ?

    Armtrac are IPC AOS members , not BPA AOS members, B W Legal will be acting on their behalf

    They can't log in on MCOL unless the CNBC sent them the claim form copy (which they won't have done).

    But we need to see what the CNBC actually just sent (redacted) and NOT the reply forms please.  We need to see the Particulars of claim.

    If you've got the POC you can email to acknowledge them and ask the CNBC to update MCOL.

  • Thank you for help so far. I phoned CNBC yesterday and after 1 hour 30 mins wait call was disconnected as it was closing time, 17:00. Luckily rang this morning promptly and after a 30 minute wait got someone who straight away emailed all info and POC (one sheet)...yay.

    I have emailed acknowledgement of service and ticked I intend to defend all of this claim.

    The date of issue was 13th Feb and date of service 18th Feb. So got to calculate how long I've got to get my defence together later. I know it's simple maths but need a cup of tea after sending my email.

    Amount claimed is £160, court fee £35, solicitors cost £60...totalling a claim for £245.

    I will look at the newbie thread and what is on here. But any other guidance or heads up appreciated...as guess each defence is slightly different.

    My issue was...paid, still have ticket, put wrong reg in. PCN received for £60. I offered £20 admin fee. Admin fee declined as they are not BPA but IPC...but thought it was worth a go...I think £20 okay personally but £60 ridiculous for £2 parking I did pay. Loads of threatening emails, letters and phone calls ignored...and now I'm here...AOS emailed, and guess just got to put together a good defence letter.

    I really appreciate this forum, it has helped me so much. It's not so much the money but the lack of humanity and threatening nature of it all. 

    I did contact my local paper and they are going to contact the security company as its such a bizarre way to deal with a small matter. If I decided to not pay parking fair enough, but preying on people's mistakes or lack of WiFi etc to this level and amount of dough is greedy and cold.

    So if Armtrac are the claimant,  which lawyers were used  ?  Gladstones   ?  B W Legal   ? Moorside   ?  DCB Legal   ?

    Post a redacted picture of the POC after hiding personal information like the VRM details first

    Fine. Usual templated defence.

    By all means bring up the £20 code of conduct point. "We're not part of that trade body" just makes them look highly unreasonable.
  • The lawyers are bw legal. Attached is redacted POC. I wrote solicitors cost incorrect...is £50. Blooming fingers...I gotta make sure I don't type the wrong reg when parking next time  :#

    Interesting to see what the CNBC can send.  Hadn't seen that before.

    Use the Template Defence and write para 3 to respond to the POC.

    Exciting...on 28th Feb, on my local news online, Cornwall Live, had this article...local woman not only won wrong reg pcn on app against Armtrac...but they had to pay her £100 compensation / damages. Definitely referencing this.
