Hi
i have read the newbies thread and would like some advice. So I received the below letter back in November , I didn’t name the driver as it was my pregnant wife with our toddler, she must have parked slightly forward so she has space behind to get a pushchair out as the car park is always busy and last time someone almost drove into her as she was putting our baby in there . I replied with the usual template to group nexus about not revealing the driver and how I am the registered keeper and they responded with the below last month. I didn’t response and I now have received a letter from Debt recovery for £170! Group nexus also issued me a popla code do you think I should Go down the appeal route ? I am getting quite anxious now after receiving the debt letter this morning.

Popla codes expire after 33 days, so due to the length of time involved its too late for popla, especially if the debt collectors are involved
IGNORE the powerless debt collectors letters, see post 4 in the newbies sticky thread in announcements
Ideally try plan A, post 1 in the newbies sticky thread in announcements1 -

They have 6 years to sue you or a known driver, using mcol
You can name the driver anytime up to a court claim being issued
Plan A is your best option, it always was and still is2 -

So in actual fact the DRIVER parked the vehicle in or over the hatched area ( they are mistaken if they said that YOU were in a hatched area, people are always in hatched areas ) its the vehicle itself that was observed, the non driving RK received the postal notice etc
Ignore them all
Come back to this thread if or when a legal company such as DCB Legal contact you1 -

You only end up paying (not amount Nexus claim) IF it goes to an actual hearing and Judge rules in Nexus favour.
This industry always threaten legal proceedings they feel it scares people into paying whatever sum they demand. Court claims can be filed but their stated confidence at winning in court so often seems to disappear as the hearing and payment fees due date nears. Time and again it ends with a notice of discontinuance as this thread shows.
