GXS PCN Appeal - Bedford Row, Worthing

Hi,

I went for a day trip to Worthing and parked in Bedford Row. I followed the huge yellow NCP sign and paid online. I also noticed a small ticket machine that was out of order and presumed it was an old one. However, another member of the public gave me her ticket with 30 minutes left on it while I figured it out. I then paid for 5 hours on the NCP app since this was the only glaring thing around and was also next to the car.

When I returned to the car I had a parking ticket stuck to the windscreen. It was from a company called GXS. It appears there were two carparks in one but there was no boundary, no lines and where I had parked was right next to the NCP sign.

It appears I have made a few other mistakes as within 2 days I appealed on the GXS website and outed myself as the driver (before reading that one shouldn't do this). I didn't get a confirmation email but every time I logged into their site it said an appeal was in progress. I checked every week to see the same message.

Then I heard nothing until 14th February when I received a letter with an increased charge of £170 and was given 7 days to pay it before sending it to debt collectors. This letter was dated 2 weeks previously so I would never have made the 7 day deadline anyway. The notice on their site has changed from 'appeal in progress' to 'out of time to appeal' I emailed them to say that I still haven't had the outcome of my appeal. They claim to have sent me a letter on 13th January rejecting my appeal and also emailing me and stating that if I am not receiving post it's not their problem but to take it up with Royal Mail. They attached a letter dated 13th January but didn't attach any evidence it was sent and are also refusing to forward me the email they claim to have sent. I also stated that I would like to exercise my GDPR rights and they have completely ignored this request.

My next step was to try IAS but I can't appeal here because it is 'out of time' so now I am stuck and not sure what the next steps would be. GXS don't appear to be a member of POPLA. And today I received a text message TRACE DEBT asking to call them urgently. I haven't called them but I am presuming it's to do with this issue. My issues here are:

a) There were no clear boundaries in the car park to even suggest that GXS and NCP operate in the same space. Signage was not obvious apart from a huge NCP sign

b) I paid for parking on the NCP app and provided this as evidence to GXS

c) GXS did not respond to my appeal before increasing the charge and threatening legal action

d) GXS are refusing to forward my data and refusing to provide the dated email the claim to have sent

e) This has prevented any further appeals and any next steps with IAS. I have asked IAS for an out-of-time appeal and they haven't responded.

f) It appears GXS has sent my charge off to a debt collector whilst we are still in the middle of a dispute and as a result have stopped responding to any of my emails.

Is there anything I can do at this stage? Aside from waiting for a CCJ?
