Hi there,

I recently got 2 letters to my old address from PPS London about my car fine. I recently moved down to London and got the fine in Southall, London. I remember I was heading for my night shift and had stopped for 2 seconds to get my dinner bag from family. It was dark so didn't see any signs and I had only parked my car with hazard lights (for about 10 mins). 

I want to make an appeal but not sure how to go on about it. I do want to mention that both fine letters were sent to my old address and only now picked up by the current tenant. I had changed my address as soon as I had moved but I guess it takes to update new home address. The fine seems to be dated back in Nov- Dec 2024 time. So I technically wasn't even aware and they have raised the fine to 170.

I am originally from Scotland and usually we just ignore these private fines. But I think in England its different and I am not too sure how to go on about it.

Please advice.

    They are not fines.

    It is too late to appeal.

    Was the old address where the PCNs were sent a Scottish address where the vehicle was registered at the time? 

    You should instruct the DPO of PPS to erase your old data and replace it with your current address for service. Make sure you use the word I have highlighted as it has a specific meaning with regards to data processing.

    If the address where the PCNs were originally sent was in Scotland, then also inform PPS that the keeper cannot be held liable, and the driver will not be identified, so they should cancel now to save themselves money.

    Only replace the old address with your new address if the old address WASN'T a Scottish one!  Ideally you want them to write to a Scottish (family?) address where the household won't panic & will not pay, but will open & show you the letters.

    I know the tenants, so they opened the letters. My old address was the Scottish one and now I am in England.
    My vehicle was registered in Scotland then and changed to England later on.

    Whats the best way to contact the DPO  ? - on the PPS website I can contact them via email , phone or a form. Though won't they be able to identify the driver and track it via email ?

    Basically these are the points to cover in the letter -
    1. Data Rectification Request
      As per the UK General Data Protection Regulation (UK GDPR), I formally request that you erase my old address from your records and replace it with my current address for service. Please confirm in writing that this update has been completed.

    2. PCN Liability Clarification
      The vehicle in question was registered at a Scottish address at the time of the alleged contravention. As you are aware, under UK law, the registered keeper cannot be held liable for private parking charges if the vehicle was registered in Scotland, and I do not intend to identify the driver. Given this, I request that you cancel these charges immediately to avoid unnecessary costs on your part.

    3. Further Correspondence
      Please confirm in writing that the charges have been cancelled or provide a detailed response explaining your legal basis for continuing to pursue them. Additionally, please ensure that all future correspondence is directed to my new address.

    Should you fail to comply with this request, I will consider raising a formal complaint regarding improper handling of my personal data under data protection laws.

    PPS should have a privacy page with contact details of the DPO. If not, send it FAO the DPO. If sending anything by email, always send it to yourself as well.

    As above... I don't understand why you would change the address to one where you can be sued, from a Scottish one where they won't even try.

    The reason I changed the address is because I moved to England so vehicle needs to be registered here.

    But now there is another letter from trace (debt recovery) sent to the old address in scotland about paying the 170 pounds !!

    They are threanthing that private parking solutions london could apply for country court judgement ?
    But they also mention about heloing inform our client's decision.
    They have given their contacts to phone them

    When I had contacted private parking solutions through email for apeal, I didn't get any response back.

    I am not sure what to do ?

    BUT you do need to make sure you have access to the letters going to the Scottish address, so you know what they are up to!

    Yes, the current tenant sends me the letter pictures. My worry is the whole threat about court and stuff.
