Thanks so much for your reply.
I had to check we do have legal protection thankfully.
Thanks for all your advice. I agree would be sensible to give them a phone (will need to be weekend when dad can watch kids) and then go from there. But I think that phoning the council about pole and then asking them to explain is a good point. I briefly spoke to the council about it before and she stated he needed to realise things don't work the way he wants it to which made me think there was more too it as well.
I agree. I think they know exactly what they are doing. Very annoying as they have a massive side garden that gets all the sun which we don't have as we have more houses but he's end of street so got about twice the garden of us so no need.
I'm hoping it should be easy enough as he's a tenant and not owner. We are very calm and chilled out people so will work in our favour. Will try and get a photo soon of how to split is on the back of houses.2 -

It's a Trumpian way of operating; they act sooo entitled, sooo seemingly certain they are right, sooo pushing the boundaries, that you can actually feel 'bad' for challenging them!Just matter of fact. And you are backed by your LegProt.See how you get on with the council's help, and hopefully that'll be enough. But if you need to talk with the neighbour, then record it. Keep all recordings secure, and don't share them with anybody. Just use it so you can relate, verbatim, what both parties have said. Then call your LegProt - you have it, you've paid for it, so be fully guided by them. In the unlikely event that this needs to go full legal, you can then inform your LP solicitor that you have the recordings, if needed, to back up what was said.

Update on the fence situation.
We were on at the council for few weeks to instructe their tenant on boundary and to move his things. No luck with that so we continued on with fence. Company delivered materials the day before. Neighbour came over shouting about boundary etc I said calmly if you have an issue you need to take it up with the council as I have a legal document stating this is my land the council weren't contesting it. The only issue is you believe this is your land. He was on the phone to the council who phoned me back to say they will come out the next morning plot the boundary for us and discuss with the neighbour so he knows. This was done exactly where we had been saying but it was ideal to have this exact measurements done for us. Council stated as long as 100% in our land then we can build the fence. Which we have done and the council moved all his stuff. The clothes pole ended up on our side of the fence which the council came out yesterday and gave him a new one but they have left the old one but said it now belongs to us.
I am just so pleased now can have the kids in garden.12 -
