MET NTK Parking Charge Notice BP South Mimms contains the PoFA 28 day warning

Hi, petrified of being annoying but I’ve got myself completely confused reading through posts 🤪


NTK received BP garage South Mimms Services.

Daughter’s car, strange sounds early stage of 2.5 hour journey, stopped, purchased oil & coolant. Called AA & waited, thankfully not for the 3-4 duration advised.  


As a note, I was with her (mother) had just been to my mums home for first time since her recent passing, all very stressful and sad.  Car making worrying sounds & initial 3-4 hour wait for AA advised felt like the last straw during a very stressful recent times & I was ready to lose the plot. 


We made it home safely thankfully, singing ABBA songs all the way (please don’t penalise us, it covered up the noise & distracted our fears!!) avoiding the 7 hour plus recovery vehicle process but totally shocked to receive fine!  No idea could get fined for being in petrol station??!!


Rang BP garage, staff member said had we made contact sooner would have been able to cancel, apparently there are iPads to put reg in, but as some days had passed would have to go direct to MET, explain situation and they would cancel.


Been meaning to contact MET to appeal under grounds of breakdown but life been very stressful recently and overwhelming & been procrastinating.  Suddenly thought to look up for guidance this morning on early wake-up.


So I’ve worked out that this is a POFA (period of 28 days wording) just uncertain of next steps.


a) use standard appeal template still (do I take anything out as a POFA?) & add in details of driver (as POFA NTK)?


Also should details of purchase of oil & coolant & breakdown fear on long motorway journey, AA call & attendance be added in?


Or


b) go back to BP with stronger complaint attempt to have cancelled?


or


c) both a & b?


Apologies if I am being dumb here, would be grateful for support to silence my overthinking brain….

    Are you still within the appeal time MET allows?
    I would suggest doing b) email this time and also email your MP explain situation include copy garage response. Ask for his/her help in complaining to garage and MET about this unfair pcn when car was broken down.

    Yes I am still within the 28 days appeal time for MET.  Not sure how long it may take for the garage to respond though if I go back to them as only telephoned last time.  Think I read somewhere that I can delay by replying I am getting advice….?  I’ll have to look back.

    You might be thinking of the 30-day hold once you receive a letter of claim but it looks like you are at appeal stage so it doesn't come into effect yet.  Is it feasible to go to garage rather than phoning; often a face-to-face request is harder for people to ignore!

    The NtK breaches the PPSCoP on appeals. It incorrectly states that appeals must be made within 28 days of notice issue rather than 28 days of notice receipt. It may come in handy at POPLA after the initial appeal is rejected (it will be).

    You'll have to work hard to convince the current crop of moronic POPLA assessors that a breach of the PPSCoP invalidates the PCN. It also means that if they are in breach of the PPSCoP, then they are in breach of the KADOE contract, which warrants a DVLA complaint.

    And should there be admittance of driver information or just do from registered keeper?
  • Have I found the right one?  Just paste this into the online appeal box?  That basic or do I add breakdown details? 

    I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

    There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.

    If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.

    If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.

    Yes but it won't 'work' (except to get you a POPLA code).

    The BP Complaint is what will work.

    I am complaining to BP too, going to go in person as will be in the area on Friday so thought in person better.  Correct me please if wrong on this.
