Napier, B W Legal court claim 2025

Hi, I was meeting a friend in Northfield and pulled in to a Napier carpark. I found out 5 minutes later I was at the wrong carpark so left. When I met my friend she said she had got a parking ticket from that carpark before so I called to find out the grace period. I was told it was 5 minutes but I had been there 7 minutes! I asked if I could pay the £1 for my parking but they said no. I received a parking ticket and appealed it, of course it was declined but I then missed the time frame to appeal through POPLA. I am now receiving letter from BW legal asking for £160. Do I pay or fight it? I've read so many posts and reviews and I still don't know what to do. It's ridiculous for being 2 mins over when I never even left my car. Please help. I have 5 days left to decide else I guess it will go up even more.

    But that £160 letter is covered in the 4th post of the NEWBIES thread.

    It never goes up more because you won't pay it even if you get a court claim. You will defend it with our help. Read the second post of the NEWBIES thread too.  No link needed.

    Very few Napier cases go to a court claim.  Obviously there is NO REASON to pay it.

    Hi. I have had an email from BW Legal to say they received my email (and to tell me again how i am still liable for the charge after my 7 minutes in the carpark) which was the template off here asking for a further 30 days and to let them know i am still disputing it. I'm just not sure what stage i am at now. Do i need to do the Defence email now?
    I'm also not sure what the logging in on .GOV is about?? Please help.

    Read post 2 of the NEWBIES thread as preparation and why not do a Google images search for Claim Form so you know what it looks like? Comes from the CNBC at Northampton,

    Hi. So I have now had the claim form through. I have registered on MCOL and completed the acknowledgment of service. It all feels a lot to take it and I'm not understanding the next step. I know I now need to do my defence and have found a defence template to follow on here that is very long and goes up to point 30! Am I meant to write all of this on MCOL in the Defence? If so what do I change in it as a lot of it doesn't make sense to me, im not sure what it is all saying. Please help.

    No, the guide specifically states to EMAIL the defence and not to use the tiny MCOL defence box.

    You need all the points in the defence changing only paragraph 3 to suit the situation.

    Post the Particulars of Claim and we can make further suggestions.

    Ok thank you. The claim is that I spent 7 minutes in a carpark that only has a 5 minute grace period. I never left the car as I realised I was at the wrong carpark to meet friends, so left. Called Napier carparking 5 minutes after leaving the carpark when I realised I could get a ticket as a friend told me she had got one there. I asked if I had been there longer than the grace period and I was told I would just have to wait to see if I get a fine. I also asked if I could pay the £1 to cover my 7 minutes there but I was told no.
