Napier, B W Legal court claim 2025
The old title is outdated and doesn't tell anyone which stage you are at2 -
Hi. I am searching the site but can't find the Defence template that goes up to point 30. I keep finding shorter versions. Could someone please add a link to it. I need to complete it ASAP. Thank you

Hi. I have only added in paragraph 2 that i was the driver at the end. If you could help with paragraph 3 please -The facts known to the Defendant:2. The facts in this defence come from the Defendant's own knowledge and honest belief. Conversely, the Claimant sets out a cut-and-paste incoherent and sparse statement of case. The POC appear to be in breach of CPR 16.4, 16PD3 and 16PD7, and fail to "state all facts necessary for the purpose of formulating a complete cause of action". The Defendant is unable, on the basis of the POC, to understand with certainty what case, allegation(s) and what heads of cost are being pursued, making it difficult to respond. However, the vehicle is recognised and it is admitted that the Defendant was the registered keeper and driver.3. Referring to the POC: The defendant did not breach any terms and conditions displayed as no where does it state within the carpark what the grace period is. The defendant spent 7 minutes in the carpark, not leaving the vehicle and then left the carpark after realising they were at the wrong meeting point. The defendant realised 5 minutes later after meeting with friends that they may have been in the carpark over the grace period so called Napier Parking to ask how long the stay had been. Napier parking said they can't tell them and to wait to see if a fine comes through. The defendant asked if they could purchase a £1 ticket to cover the time spent in there but was told they couldn't. The defendant was not aware of the short grace period in this carpark of 5 minutes as this is stated nowhere.1
