We are owed money back for our car. Bought in 2019. My husband has just died the claim is not yet settled do I still get our money back as his NOK? The finance agreement ended but I’m still paying for the car with a personal loan as we decided to keep the car after the agreement ended but still owed £6000 it would’ve been less if we’d not been missold thanks

Sorry to hear of your loss.
Why do you think you are owed money?
Has your lender advised your loan was subject to discretionary commission?
The investigation has not yet been concluded and no level of compensation has been set.
The balloon payment itself would not have been any different so I don't know why you think so.
Have you made a claim through a third party claims company?0 -
Thanks for the post but I’m not saying we are entitled as I am
aware it is still ongoing. I Just wanted to know if I could
claim on his behalf as his letter from Blackhorse finance stated basically that we did meet the criteria and they will
keep us updated. My friend’s letter said she didn’t meet the criteria but that isn’t the issue here - the question I’m asking is if we do find we are entitled can I claim the money owed on our car finance on behalf of my late husband. Thanks

it is not unusual for claims to be made on behalf of the estate of someone who is deceased0

You can continue the claim even though your husband has passed away.
However, don't expect any change to the £6000 balloon figure.

it would’ve been less if we’d not been missold thanksHow were you missold? (DCA is not a missale)as his letter from Blackhorse finance stated basically that we did meet the criteria and they willAt this stage, all Black Horse are doing is checking whether the dealer was able to use DCA or not. Yours says it was. However, DCA can be positive, negative or neutral.
keep us updated.
Positive is where they lower the interest rate (often done during promotions on a vehicle or to get a sale over the line)
Neutral is where the dealer could use DCA but didn't in your case
Negative is where the interest rate was increased to give a greater commission. My friend’s letter said she didn’t meet the criteria but that isn’t the issue here - the question I’m asking is if we do find we are entitled can I claim the money owed on our car finance on behalf of my late husband. The executor of the estate is the one who has the legal ability to act on behalf of the estate. So, yes, they can make a complaint and act on behalf of your husband. But don't get too premature on this. Until you know what type of DCA was applicable, you don't know if anything will apply or not. Plus, the issue is still going through the courts.
