DCBL second letter received

Hi everyone, 

I know this is probably tedious for some of the experts here to answer but I have received now my second letter from them (DBCL) in regards to a parking fine. 
I have looked at the newbies forum and read all the relevant parts but the thing is, in my particular case I never even got the fine from the parking operator themselves before they passed it on the the debt collection agency. 
Had I got the original fine I would have probably paid it (this was in November)  and the first I known about this was a few weeks ago when the DCBL letter arrived. 

Would not receiving the operator fine be in any way be a defence should I got involved in a small claims if dbcl decides to pursue it further?

    Not receiving paperwork is no defence,  so no is the simple answer 

    Not receiving paperwork is usually due to the Registered Keeper moving and not updating their dvla vehicle database details promptly,  a legal obligation that could attract a real fine,  so get it done ASAP if not done already 

    If you did move,  email the DPO at the parking company and dcbl with the correct address details for the service of papers and tell them that they must erase any old addresses from their records,  known as a Data Rectification Notice 

    DCBL cannot and will not even try to enforce the pcn, certainly not via a court claim,  debt collectors can't do that 

    The private parking company can issue a court claim against you,  using companies like DCB Legal or similar,  so probably will,  but you haven't told us which parking company is involved yet,  or if DCB Legal are involved yet 

    Ignore the powerless debt collectors letters

    That’s the thing, I’ve not moved or changed address in years and my dvla details are all correct. The only thing that I can think of is I changed the car reg in September and thats all completed with new log book v5 issued etc.

    i believe the operator is NPC (photo attached)

    This shouldn't impact them getting your correct address details from the DVLA.

    As this is the lovely NPC group - you will receive a further letter from DCBL and then likely one from DCB Legal which will likely be a LBC, Glad you didn't get the 'invoice' (NOT a fine) - as it means you didn't pay it!

    Read this thread about a potential way to get DCBL and/or Legal to drop hands on this, I now know of a few cases where this has worked, especially as Gr1pr has said, it very rarely see's the inside of a court room with DCB Legal (see @Umkomaas excellent thread on discontinuations)

    You may be able to head this off from the DCB perspective, but as always, read the NEWBIES thread and follow the system, it works

    Now then, when I put this code in it brings up the above car park, which looks like this on Ringgo's site.




    is there where you parked? or did you park across the road in front of the shops? actually on the parade? Is the sign you've included for the parade or the barrier controlled car park opposite (I think the former)?

    Yes, thats the place! I have seen a few people complain about parking there. It used to be a pay and display but changed to cameras. There is also no barriers there and very little signage apart from the picture I included which is at both ends of the car park. (There is a Reddit thread about this place)

    Also, in regards to the thread posted about the personal data access, how do I go about doing that? Or should I wait for a LOC before I do anything?
