  • With respect I am somewhat wary of the comment that all this is 'no biggie' for the OP.  Any legal proceedings will cause distress and anxiety to a lay person. Do said forum members, and/or the forum, offer some form of a guarantee or indemnity if the OP follows the specific cut and paste defence wording and guidance as recommended on this forum? I doubt it. 

    I have a friend in a similar position to the OP.  Again they parked in haste on some UKCPS administered land and did not realise the consequences. My friend has ignored all related correspondence to date which mirrors the OP's. My friend re-visited the parking area and spoke to some local business owners who told him that they were aware of many of their clients and service users who over recent months and years had received PCN's from UKCPS followed up by various intimidatory items of correspondence from their agents. All such clients ignored such correspondence and eventually the correspondence ceased. However, none of them ever received a formal court claim. The introduction of Moorside Legal appears to have upped thee ante. Do you agree? 

    It may well be that Moorside Legal (who are a small Bradford based law firm) are being paid on commission, but to date are there any examples of the firm, or any agent of UKCPS, having ever made a successful claim in respect of their PCN's in a small claims court of England and Wales?

    Yes there are more claims when Moorside hoovered up parking companies as clients last year,  so upped the numbers,  maybe not the ante,  that remains to be seen,  but my bet is that they will follow the  DCB Legal route,  as seen in the tally thread by Umkomaas , which is over the last couple of years 

    Given that court claims can currently take between 9 to 18 months to get to a courtroom,  it's more of a case that the answer to your question is currently an unknown 

    We may have answers by Xmas or next year  !

    We have seen these legal companies come and Go, like Wright Hassall

    But this isn't your thread so for further advice on your own case, please start a new thread of your own

    Involving Moorside Legal has led to court claims but no, I don't call using a roboclaim legal firm as "upping the ante"!

    Have you seen their woeful Particulars?!

    The point is these are a cinch to defend and they are copying DCB Legal's (old) badly pleaded POC and are likely mimicking DCB Legal's entire MO.

    Which means they'll discontinue before hearings. Or Allocating Judges may well strike their claims out.

    Thus: no biggie. Nothing risked.

    We don't need to indemnify anyone because there's no risk. You already know from the NEWBIES thread that even if people lose at a hearing, as long as they know how to argue against the fakery of the added £70, they pay LESS than the claim!

    And letting cases go to court claim stage brings in Mediation phone call stage (the D can make a low offer) that is a discussion that simply doesn't exist at £170 threatogram stage.

    What's not to like?

    Thanks for your reply. I do. however, think that you may be underestimating the distress and anxiety that is caused to lay persons by these claims. It may not be 'a biggie' in your eyes, but to many it is. Further, for many people/ defendants they know that they should not have parked in such locations in the first place.

    In fact I don't underestimate the emotional effect at all, and have helped people like this for well over a decade with parking court claims.

    I've also attended as a lay rep for complete strangers, attending hearings in front of Judges for no reward (I have never lost). Defendants are often scared witless. I get it. Seen them with my own eyes!

    But 80% of what we do here is giving people the confidence to defend a claim and the knowledge that there is no risk.

    Hence saying "it's no biggie" which isn't trying to ignore their distress: quite the opposite.

    Quick phrases like that to stop people panicking and paying is part of the approach used to calm people down.  When they feel ready, we then give them the confidence and info to win their case.
