I wasn't aware of timescales and noticed acknowledgment email said please do not chase so I didn't for a while just assumed it was the wheels of justice turning slowly! Anyway I eventually did chase to be told they'd lost the docs so I had to send them again.
I've now got a date. Obviously its fallen on a day I'm on a 12 hour shift in another city. Apparently I have to pay another N244 fee to request a date change which I wasn't expecting another punch in the gut. That's £600 now honestly wish I'd just paid the parking tickets at this point but I guess that's what they want.0 -
Email the local court saying that consent from the Claimant has been obtained (see attached) and point out this means the date can be vacated and needs no application or fee.
Secondly, list your future unavailable weeks to stop this happening again. Err on the side of exaggerating unavailability just in case, and plot it for six months.
Thirdly, once that is sent, we need you!
If you want to be part of the push to change things in future, it's very important that people like you join us to reply to the new Public Consultation, to tell the Government NOW that:
a) you have no faith in POPLA or the IAS and that there must be the SINGLE APPEALS SERVICE that the Parking (Code of Practice) Act 2019 *almost* promised. As long as it is independent (and only ONE appeals service, not two involved in a race to the bottom) that will give a real option to resolve disputed cases out of court.
b). THAT THE ENRICHMENT OF 'DEBT RECOVERY FEES' MUST BE COMPLETELY BANNED. DISPUTED CASES ARE NOT SOLVED BY A THUG THIRD PARTY DEMANDING MORE MONEY AND ENGINEERING A POINTLESS 'PAYMENT PLAN'.
c). Tell them about your experience and that your case proceeded to a claim precisely because (a) and (b) above mean there is no option, no safeguard for consumers EXCEPT court.
Responses are invited to the Consultation now:

Still not heard from the court about an adjournment. Does say takes average 10 days for a response but it's now only 8 days til the hearing so getting a bit close.
Also, had a voicemail and email from their solicitors offering to settle it and set aside the CCJ........IF I pay the £400 odd quid they wanted in the first place! I haven't responded.0 -

Sadly, some judges have fallen for Claimant Draft Orders so be ready for anything at the hearing.
The entire Claim should be struck out as expired and all YOUR costs awarded, per the binding - your judge has no discretion - authority of good old VCS v Carr (thank you to VCS and to Jackson Yamba for that landmark case!)
And if you want to be part of the push to change things in future, it's very important that people like you tell the Government that:

As long as it is independent and impartial (and only ONE appeals service, not two involved in a race to the bottom) that will give a real option to resolve disputed cases out of court.
b). THAT THE ENRICHMENT OF 'DEBT RECOVERY FEES' MUST BE COMPLETELY BANNED. DISPUTED CASES ARE NOT SOLVED BY DEMANDING MORE MONEY AND OFFERING A 'PAYMENT PLAN', NOR BY SENDING LETTERS TO UNCHECKED OLD ADDRESSES AND ADDING A £70 REWARD FOR CAUSING CONSUMER HARM BY CCJs.
c). Tell them about your experience and the complete and utter waste of court resources caused on a grand scale by DCB Legal,

Found out my employer offers an advice line for various things of which legal advice is one. I called it was quite useful and helpful didn't tell me anything really earth shattering just agreed I have a good case for set aside but when I was getting my documents ready for the call I noticed that on the POC postcode is wrong. My defence is that my apartment number was missing from the correspondence but I'd not noticed the incorrect postcode on the POC as well before. So the N1SDT will have gone to that postcode.1

Good point to show it was improperly served.
Is the address wrong or incomplete on your logbook then?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
