Council Wheelie Bin damaged my car

    The council supply the bins but responsibility for keeping them where they should be kept is down to the household/business.  Unless you can determine who that is you aren't going to get anywhere.  Added to that, it would probably be put down to storm damage by an insurer meaning you would have to claim off your own insurance.

    yes you brake, if the car behind hits you its their fault. It was easily avoidable. from the moment the bin moved you took nearly 7 seconds to come to a complete stop?

    yes you brake, if the car behind hits you its their fault.
    I did brake as efficiently as the conditions allowed. Emergency braking on a steep hill covered in water could have aquaplaned me into the oncoming van! I am quite capable of making an emergency stop where conditions are safe to do so - in this case they were not. I am beginning to think that this forum is stuffed with smarta****!

    Find out who the bin belongs to, as in which house, & ask them to sort the damage. Short of that there's not a huge amount you can do really.

    Does your car not have ABS? End of the day you drove into the bin when you could of stopped. If you couldnt stop then you were driving too fast for the road and weather conditions.

    If you actually bother to watch the video instead of being so ready to critique others' driving you would see the pedestrian protection system jack the bonnet up. This only occurs at speeds of between 25 and 32 MPH in my vehicle so I could not have been going to fast could I? Incidentally there is an apostrophe in couldn't! Also braking so suddenly and causing others to run into the back of you unexpectedly can leave you open to putting other drivers in peril on the road this means that it is not automatically the driver's fault that rear ends you. You may wish to note that in future if you decide to slam the brakes on!
