OK, so have this in your crib sheet notes for the hearing:
- their own evidence shows there is no entrance sign at all, confirming the evidence in the defence WS.
- they've included a mock-up picture of an entrance P sign (see BPA Code of Practice version applicable in 2023 - an entrance sign is mandatory) but it isn't on site.
- there's just one single set of signs beside the graffiti on the left; only one with t&cs, despite the size of the car park and how busy Google Streetview shows it to be. No other signs are evidenced anywhere.
- This is why entrance signs are crucial to put drivers 'on notice' that this is private land and to read the terms on signs inside. All it would need to fully obscure that sign is one van reverse-parked up to it.
- RCP are also in further breach of their Trade body Code of Practice because there is no BPA or IPC Roundel on any sign. That is also mandatory in the Code of Practice (which is more than just guidance, it is the basis of DVLA release of data and it was stated by the Supreme Court in ParkingEye v Beavis to be effectively regulatory).PRIVATE 'PCN'? Not clear on how these things go in terms of structure or format so if anyone has any tips or information that would be good?
