Court hearing was yesterday.
It went incredibly quick, and I didn't even have to say much.
The Judge ruled that yes he would dismiss the case and set aside the order.
With regards to them hoping I wouldn't ask for, or would be denied my request for court costs to be covered, the Judge was having none of it. He said he wasn't satisfied with their none-attendance, also with their statement that they done a 'trace and search' for my address before serving my papers.
He said 'I don't even know what a trace and search is, what that would look like. There's no evidence they did that.'
He practically encouraged me to ask for my court costs to be paid, even though the claimant provided all the legal jargon for why I shouldn't receive those.
He had some initial confusion about why/how the court papers were sent to the wrong address which was surprising because I sent all my evidence about the change of address (mortgage welcome letter/utility bill). He thought my current address was where the papers were served until I explained they went to a previous one. After that he was happy to throw the whole thing out.
The one big regret I have is that I didn't ask for expenses!
I was in no way expecting that question, as there was some doubt about even receiving my court costs, but he said right at the end 'I will order your costs to be paid, unless you have any other requests for costs.' Got a bit flustered to be fair and just said no, not wanting to put anything in jeopardy.
Definitely think I should have asked for costs for time, labour, travel costs to court, and stress!
