Think WE have established this now1

Will whoever you hire the car from (as long as they are the keeper) be content to fill in the transfer of liability slip when the NTK arrives?brab888 said:Think WE have established this now
If you are certain they won't pay it like numpties, then let them get the NTK next month then transfer liability to you as Hirer (note, not saying you were driving).
Then when you get your NTH in your name, you then appeal as hirer. Easy win.
If you can't trust the keeper fleet team not to pay it, do as advised and appeal in this case (due to all the facts, including that APCOA are toothless) as DRIVER to completely keep the fleet manager out of the matter. You could state that no t&cs signs about a risk of £100 PCN are adjacent to the EV bay so no such terms apply there, only the instructions about charging. And secondly, the PCN doesn't state any breach!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Perhaps they've cottoned on that's it's the same employee that's decided to use this EV bay as a personal parking space on a frequent basis.brab888 said:The thing that pisses me off the most is weeks ago I parked there in my Skoda (non EV) risky but zero spaces elsewhere but HAD to start my shift and I got a ticket but with £0.00 for the request… now I have this. Baffles me3 -
just appeal it as the driver and thats it job done1

Just so you know from my or other volunteers experience here
Some 14.6 million private parking company charges ( invoices ) are being issued annually at the moment
We are seeing a big increase in EV bay ones where people have not registered for a charging exemption, or overstayed, or parked without charging, or something similar
We have seen Tesla ones at hotel charging points, I expect to see many, many more, nearly all are hired or leased, no matter which manufacturer they are
We are seeing plenty at fuel stations, both EV and fossil fuels included in the various charges,
We see hundreds of cases, probably thousands, where people cannot or do not see or read the signs
The comments may be critical, but the aim is to modify various behaviours by drivers to stop the repeating patterns, the medicine might taste badly but its good to know where the proble are and how to avoid them, prevention is better than cure
Had it been Parking Eye or similar then the outcome could be worse, although private companies tend to fail on hirer liability, especially Apcoa
Lastly, we have seen threads regarding doctors and nurses etc at various hospitals, but the parking issues are between them and the trust, the most notable case being UHW in Cardiff when Indigo had the contract, more recently it's Parking Eye, but the parking problems are still cropping up here for UHW, Warrington, Barnet etc , despite the NHS guidelines
My advice to you is to try to actively prevent future pcn's arriving, which those of us replying tend to do
Insight and knowledge are very useful when applied
Good luck anyway, because following the advice given should see this pcn remain unpaid

I totally agree with what you’re saying however sitting on pedestals is not my game never will be. I thought this forum would be a place for learning and advice rather than instant judgement.
But the fact remains we are all human. We make mistakes and learn from them. If there were actually clear cut signs saying do not park here if not charging I would’ve tried the other places first. But here we are. The signs are crap and it’s an ongoing issue with the trust but the fines and charges remain a separate problem which I previously have had friendly help for on here. No different to this situation and yet the behaviour has changed, there’s no excuse. Teach and move on.
No one is born with insight and knowledge, it’s definitely gained through experiences and situations like this.2 -
I didn't judge you and I gave advice about points that could help you win the appeal. Good luck!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
