Ticketmaster denying responsibility for a claim

Options
All, I booked concert tickets via Ticketmaster. For reasons I won't go into here, I am trying to claim a portion of the ticket cost back, because I feel that the tickets were misrepresented on their website and possibly in breach of the Sale of Goods Act (misleading advertising). Payment for the tickets was made via Ticketmaster UK.

Ticketmaster are denying all responsibility and assert that they were merely acting as an agent for Live Nation, and that it is them who I should be pursuing. They claim all this is listed in their terms and conditions.

I could just use a little advice as to who I should be directing the claim at if I open a small claims case. I don't at any point recall seeing any communications from Live Nation. If I purchased the tickets via Ticketmaster and paid Ticketmaster for them, surely my contract is with them?

You need to carefully read the Ticketmaster Ts and Cs before deciding who you can take action against.

They are very likely telling you correct information.

As above, read the T&C's. Live Nation own Ticketmaster but it's essential you cite the correct party or you will be throwing money down the drain.

That contract will clearly spell out the terms on which you purchased the tickets.

What is worrying is that OP thinks they have a case because of 'misrepresentation' but can't even identify who their contract is with from the T&C's. Not to mention that they don't want to go into details about why they think they have a case, always a concern.

Part of the problem is, the T&C's were on the tickets themselves. As they were electronic tickets on my phone and I no longer have access to them, I am currently unable to check them.

As to why I don't want to go into details, I simply haven't got the time to spell it all out in detail. But put simply, I purchased tickets to a section of arena that did not exist on the night.

Which venue was it? Live Nation may own the venue and that is why you are being directed to them.

Is your claim based on the premise that where you did end up being seated was objectively inferior?  Did you remain at the event, or leave because the paid-for seats didn't exist?

As advised by others, you'll need to read the terms carefully to make sure that an alternative seating location isn't a reasonable position, and above all, know which entity it is that you're claiming from.

    Ticketmaster general conditions - https://www.ticketmaster.co.uk/legal/purchase.html

Clause 8.4 covers allocated seating if that's aporopriate here.

The venue was the Co-Op arena in Manchester. I purchased tickets to the VIP GA section in the image below. There wasn't actually a VIP GA section, it was all GA. It was actually an "early access" package. I feel that this was misrepresented.

Without seeing the T&C"s of the specific ticket it's impossible to say if you have a case. If it was early admission I'd expect the VIP GA area to be first come first served - you say it did not exist - how do you know the people in that area just didn't get there before you? (assuming people were in fact there)

How much extra was the ticket you bought compared to a normal one, enough to justify the time and effort?
