Sadly my mum passed away early January. I thought I might try to do probate myself. There is only the house that needs probate. I cannot work out if I need to complete a IHT400 form first. House value is £600k, she has £42k in her bank account and gifted in the last 7 yrs £145k.
I thought the iht band was £325k plus £175k for property for herself and my dads was passed to her when he passed 17 yrs ago.

Have I got this correct and would I need to complete a IHT400 form. From what I have read it should come under excluded.
Any advice would be much appreciated.

If you want to claim any unused nil rate band and residential relief from your Dad's estate then you do, alas, need to fill in an IHT400 and the associated sub forms. It's not automatic.0

Thank you. I shall start looking at the information that I need to complete it. What a pain although better than paying iht.kipperman said:If you want to claim any unused nil rate band and residential relief from your Dad's estate then you do, alas, need to fill in an IHT400 and the associated sub forms. Her estate would need to be below £650,001 to avoid completing a full IHT return. To cover your mother’s estate, including the gifts you need to claim her NRB and residential NRB plus her husbands unused NRB.
You will need to complete IHT400, IHT402 (transfer of unused NRB) IHT403 (gifts), IHT405 (house), IHT406 (bank account) and IHT435 (RNRB).
