CCJ from UK Parking Control - for a fine that was already paid months ago

    You need to be CERTAIN it's the same PCN.  You could be right but there could easily be two that have gone to 'debt recovery' and are at different stages.

    If I leave it until 31st January, that's after the 30 days on the letter from the court - that would mean a CCJ on my credit file for the next 6 years.

    I wonder if you've possibly overlooked this:

    1. doing a n244 application doesn't freeze the CCJ.  Even if you bung in a rushed application, you will be in the above situation anyway as soon as the 30 days is up. Rushing in a n244 and spending £119 or £303 (that DCB will try hard to wriggle out of paying you back) will change nothing.  The CCJ will hit your credit anyway and a n244 will immediately put you out of pocket ... for no reason. I suggest a two step approach.

    2. my advice was to attack DCB first, this month, because if you are right they WILL agree. I wasn't suggesting to abandon the idea of the n244 if they don't sort it.

    It is a step by step, but urgent process.

    Either way the CCJ damage hits for a few weeks/months while it is sorted.  I'm just saying if you are right then DCB will have no choice but to sort this at their client's cost.

    So why not exhaust that this month and at least you'll also learn for sure, if the family paid the same PCN that is the subject of this particular CCJ.  If there are 2 PCNs you can still apply to set aside the CCJ in February and not waste words on something that has turned out to be irrelevant.

  • DCB have just confirmed to me today (24th January) that they have sent the information to the court, that the charge was already paid when the judgment was issued and that that has been accepted by the court and the CCJ will be lifted.
    Let's see if it actually happens.

    I think they might have told the court it was paid on the day it was issued, rather than two and a bit months before the day it was issued... probably just to make themselves look less bad.

    But it basically took 3 weeks for them to go through the escalation process and check that the receipt that we sent them was "real".

    Just an aside - you say your daughter is a named driver on the insurance ?

    Whose name is the policy in and who is named as main driver ?

    if she is actually the main driver , you need to get that fixed as well

    Glad the advice worked, exactly as predicted and in January, as expected.

    Despite the regretful fact that family members were duped into paying a scam invoice they never had to pay, this is a win. We stopped you paying £303 that would have been damn hard to get back, under the circumstances.

    DCB Legal will have to remove the CCJ.  :D
