I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I'm not seeing any Sch 4 wording that says:
- we don't know who was driving
- what to do if you were not driving if you wish to transfer liability and "pass the notice to them"
So this doesn't pass as a POFA notice IMHO unless I missed that?
Not that it matters because there is no appeal worth trying to the 'kangaroo court' (IAS). Don't even try a futile 'appeal'. No point! This looks like an utter scam covert operation where you didn't even know that images were being taken, which is illegal.
So completely ignore this and future letters. Do nothing. By going confidently into the 'ignore' stance, the only steps to take are:
- Tell them if you move house within 6 years.
- Ignore the tedious £170 threatograms shown in pictures in the 4th post of the NEWBIES thread. Please go and look at them now.
- Come back if you get a LBC as per the 2nd post of the NEWBIES thread but JD are not litigious so we predict threatograms only. There is no risk AT ALL in defending a court and following our advice. Yours won't even come to that anyway
DO NOT PAY OR ENGAGE AT ALL UNLESS YOUR ADDRESS CHANGES WITHIN 6 YEARS.Hi. Thank you for the advice so far. I pretty much followed the advice given but I did say I’d like to contest this charge so please send me a POPLA code I did this on the last day I had to appeal . I realise I did it via their customer service email and not via the website and I other than the reference number I provided no other details. I assume they will say they could not accept this appeal because I did not identify myself as the driver or provide number plate/address details.Today I received this. It is quite shocking although having read the newbies thread this seems standard . But wow. How does pulling over because I felt dizzy in a place that until a maximum of 2 weeks earlier had been a free car park for over 20 years lead to a fine of £170 rising to £256.65 if unpaid.I have attached the letter they sent for others to see/keep a log of the events for this really unneeded journey.Regards.0 -
What's in the Date of this notice box at the top of that letter?
What's in the Response by Date box at the top of that letter?1 -

Plan A is always a complaint from the vehicle keeper to the landowner and the keeper's MP.
Please read the sticky Announcement for NEWBIES
If a landowner complaint is not forthcoming, then appeal using the template...
What was the reason given for issuing the parking charge?.
Reason given was “no valid permit”. I’m not sure how they would know this (as I say - I did not get out of the car. I was just feeling dizzy).it is a car park I’ve used many times, including just a few weeks before this incident. It has always been free - for decades and for as long as it has been there. There was no awareness that the terms of parking were going to be changed. I did not get out of the car but even if I had, I almost certainly would not have seen the signs anywayPlease find the NTK pictures.Coupon-mad said:I'm not seeing any Sch 4 wording that says:

This is Wonga-esque conduct.
Thankyou for showing that letter. I take it you noticed the footnote line about who really sent that fake debt recovery letter? JD Parking Solutions
I have sooo much evidence that PPC and DRA conduct and court claims have got noticeably worse since the BPA & IPC connived to concoct their own (effectively fake) version of the statutory Code of Practice, copying it word for word then putting bombs into the bits they don't like.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I've just noticed the Aberdeen address for both JD Parking and Direct Debt Recovery. Are you based in Scotland by any chance? Please note, we are not a legal advice forum. @Coupon-mad @Umkomaas
I am fairly certain I know this location as I am helping someone elsewhere who has 4 PCNs for stopping in the road next to these spaces to pick up passengers from the nearby station. The location is in the East of England.
According to the council gazetteer of streets, the road is maintained at public expense, it is adopted highway. They have been in communication with their local councillor regarding this. Their MP has been useless sadly.
My victim has also received these fake debt recovery letters. JD Parking Solutions are obviously trying to keep their schemes "in house", it looks like another Shannon at Azure Parking type setup.
I got the victim to send the normal LBC response pointing out how their letter fails the PaP and also pointing out:
"It is my position that the road in question is adopted highway and under the control of <council> and that there was no "reasonable cause" to obtain my personal data which is a breach of the KADOE agreement with the DVLA as well as the Data Protection Act 2018.
Should you persist in this matter I will consider bringing a counter claim in the sum of £250 against JD Parking Solutions for these breaches. This is the low end of the scale for damages awarded for similar cases."Always remember to abide by Space Corps Directive 39436175880932/B:
'All nations attending the conference are only allocated one parking space.'4 -
Quick update - my victim has an N1 Claim form for 4x£170 plus £70 court fee. They are also trying to claim interest on the entire amount from the date of the first PCN issued. Hoping to get Contestor Legal involved to strike out the claim.

Or ask our mutual contact who does certain work to raise money for charity; he might well be up for it...I intend to use him if my nephew gets a claim after the LBC (different PPC),PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
