Hi. I’m just looking for some guidance.
I received a PCN in the post a few days ago - the first one I’ve ever received.
It relates to an incident on the 30th December where I was driving and felt dizzy. I’m not sure if it was Christmas excess or what but I felt a bit disorientated so I pulled over into the car park of a mini shopping precinct I was passing by - one I’ve used many many times over the past two decades. It has always been a free car park and I’m sure I’ve had used it within the month before this day.

It has always been a free car park and I’m sure I’ve had used it within the month before this day.
Anyway. I parked in a bay and sat for a certain period of time until I felt safe to drive. And off I went. 12 days later I received the PCN. I was obviously surprised because of my historical use of the site and I did not see any signs at the time. It actually would not have occurred me to look.
I recall never getting out of the car nor using any of the facilities (other than the bay) and I did not see or read any signs. I do not believe I can be fairly said to have entered into a contract under these conditions. I pulled over out of concern for the safety of myself and others. That’s all.
I have since visited the site and noticed the small site does have a number of signs. It also has a sign at the entrance that says private land (although when I first saw it I thought it referred to the known private car park that is directly behind the sign and just a few metres from this previously free car park).
The evidence the PPC have provided me are two pictures from the back of my car parked up. They are the same picture with a 6 minute time lapse. No other evidence has been provided although they say more evidence is on their website (I have to enter in details and go to pay the fine to view them). The pay machine doesn’t require a number plate to be entered and there is no picture of my dashboard.
I want to challenge this PCN on grounds of mitigating circumstances bought on by a sudden bout of dizziness. A lack of awareness communicated about the forthcoming change of parking terms in a commonly frequented. And I’d like to challenge it based upon a lack of a genuine contract being formed.

I will request all evidence they have and proof I did not get a ticket. Obviously saying I did not get out of the car will contradict that so maybe I should keep that to myself?
If the general view is I should just pay then I will but I genuinely think this is unfair. I feel sad for all the people who may have been caught out like me.

Apologies for typos. I hope the post is intelligible.As I say, it is a car park I’ve used many times, including just a few weeks before this incident. It has always been free - for decades and for as long as it has been there. There was no awareness that the terms of parking were going to be changed. I did not get out of the car but even if I had, I almost certainly would not have seen the signs anyway because I would not have been looking for them. I only ever visit one shop there and typically just walk pretty much head down and straight ahead . I realise that information will be irrelevant.0

Plan A is always a complaint from the vehicle keeper to the landowner and the keeper's MP.
Please read the sticky Announcement for NEWBIES
If a landowner complaint is not forthcoming, then appeal using the template in blue text you will find in the NEWBIES. Send the appeal from the keeper without revealing the driver's identity.
What was the reason given for issuing the parking charge?
Please post both sides of the NTK. Redact personal data but leave dates and location showing.

In the picture you can see the first two parking notice signs although I did not see them at the time. The entrance is 3-4 metres to the left of the picture. I literally pulled in and parked up almost immediately to the left (the second parking bay available).There is a notice at the entrance but I did not see it nor would have I looked because a) I was feeling dizzy and panicky and b) this was always a free car park until mere days/weeks before this incident.0

As the incident was a Sunday and after 4:00pm (Sunday closing time for most), I suspect the 'contravention' was for just being there when there was no possibility that any stores could be visited - we're seeing more of these stunts of late.Please note, we are not a legal advice forum. I realise I am probably going to lose but…I don’t care. On principle I’m not paying. This is all such a scam. I’ve no idea why the public car park suddenly became private land overnight but it’s clearly to make money from innocent people and it is deeply unfair. I pulled in to a car park I’ve often used just to be safe for myself and other road users.I will not mention not getting out of the car initially and demand all evidence they have to prove I did not have a permit. And I’ll challenge the claim I agreed a contract if I never saw not read any signs. I genuinely didn’t.

Thanks for copy of the reverse side. That does contain the PoFA wording that wasn't on the front side (and which I was hoping was missing).My theory about Sunday opening is not the reason for the PCN (given that some outlets are still open after 4pm).Why not pay a visit to the car park again and ask some questions of some of the outlets there, finding out the reason for parking conditions changing, and in particular who is responsible (possibly a managing agent) for bringing in the PPC. Thereafter, a complaint to be made to whoever engaged the PPC, to see if they will intervene.Drawing blanks does not mean you should pay the charge!Please note, we are not a legal advice forum. So this doesn't pass as a POFA notice IMHO unless I missed that?
Not that it matters because there is no appeal worth trying to the 'kangaroo court' (IAS). Don't even try a futile 'appeal'. No point! This looks like an utter scam covert operation where you didn't even know that images were being taken, which is illegal.
So completely ignore this and future letters. Do nothing. By going confidently into the 'ignore' stance, the only steps to take are:
- Tell them if you move house within 6 years.
- Ignore the tedious £170 threatograms shown in pictures in the 4th post of the NEWBIES thread. Please go and look at them now.
- Come back if you get a LBC as per the 2nd post of the NEWBIES thread but JD are not litigious so we predict threatograms only. There is no risk AT ALL in defending a court and following our advice. Yours won't even come to that anyway
DO NOT PAY OR ENGAGE AT ALL UNLESS YOUR ADDRESS CHANGES WITHIN 6 YEARS.
