DCB Legal ParkingEye Court claim for two PCNs.

Hi, sorry for making a new thread if this is already covered in one of the stickies.
I wish I found this forum before but I have already got to the point with these fines that the payments have racked up, I made a defence and then they have offered a settlement (~£360).
I have until Friday 17th to pay the settlement or they will be pursuing in court.
I'm wondering if I can still defend this and win? I see in the NEWBIE sticky that apparently 99% of cases are won against these guys. It's DBC legal acting on behalf of parkingeye.
I've not made a complaint yet with the retailer, is that still worth doing at this stage?
Is there anything I can do right now to win this, or is it worth just paying the settlement and getting it over with? Will court costs be more than the fine?
I can post the defense I wrote to the county court if that helps? Obviously I wasn't aware of this forum before doing so.
I'm sure you're aware of the timeline of events by now but -
1. Fines issued, ignored
2. Warning issued and fines increased, ignored
3. Warning of legal action, ignored
4. County court letter
5. Made a defense
6. Contact from DCB legal, settlement offered before court.
Appreciate all advice that comes through!

There is no fine, were no fines, just invoices from a private parking company for the alleged breach of the parking contract on that private property
Plan A is always worth doing, even at this stage
Most claims are falsely inflated by at least £70 per PCN, £170 instead of £100
How many PCNs ? How much is the total claim ?
Definitely post a redacted picture of the POC on the lower left hand side of the claim form, after hiding the VRM details first
Definitely post the defence you submitted, minus the personal details
Exactly what stage are you at ?
When is the hearing date ?
When is the deadline for your WS bundle to be submitted to both parties ?
What date must be trial fee be paid by DCB Legal ?2 -

What date must be trial fee be paid by DCB Legal ?Total 4 claims. Two have reached the stage of settlement before a court date.I have one that is a letter before county court claim. And another that has just been inflated. I have appealed the 3 on the parkingeye website that I can.Total claim for the two that are now with DCB legal is ~£450, they have offered a settlement for these two of £360.I just tried to look for the letters for the POC but can't find them now!!Exactly what stage I'm at I don't know. All I know is they have issued the letter before county court claim, which I then defended and have heard back from DCB legal. They said parkingeye will pursue the courts if I do not settle. There is no hearing date yet, just the end of the settlement date which is this Friday 17th.I'm not sure on the trial fee.My defense email is attached.Thank you.

If I go ahead and complain to the retailer, can they still get it cancelled at this stage?

You won't know until you ask, we certainly cannot second guess what any company may do, hence plan A is ask them , not us
Need more information, your reply and anecdotes are confusing, 4 pcns or 4 separate court claims ? Try to be specific
If its 4 separate court claims , the claimant should have consolidated them into one single claim
I suggest that you get all your paperwork in order and answer the specific questions with detailed facts
Letters before a court claim is not a court claim, its the precursor to a court claim1 -

Letters before a court claim is not a court claim, its the precursor to a court claimTo be honest I don't know the ins and outs or understand it all myself. There are 2 claims that have been consolidated into 1. They have offered a settlement of £360 for these two, if I dont pay it will go to court. There are another 2 claims that I have appealed through their appeal website. I haven't heard anything back from them yet.I'm not sure how else I can write this for it to make more sense for you
I don't have a court claim then, but I have been contacted by DCB legal AFTER I replied with a defense to the LBCCC. This is when they have ask me to pay the settlement amount before the issue a court claim.0 -

Letters before a court claim is not a court claim, its the precursor to a court claimThis is what I mean when I say I replied with my defense. I was then contacted by DCB, to acknowledge the defense and they offered me the settlement amount. Hopefully I've made a bit more sense now, thanks.0 -
1. They always make an offer after someone puts in a defence. There is no "settlement date", it's just a begging letter. Ignore it.
2. Your defence is inadequate, should have been in the third person and reads like a witness statement. Go and have a look at the template defence thread.
3. When it gets to the witness statement stage (which is in the first person) I suggest you try and create a hybrid witness statement-defence ie. convert the templated defence into the first person and include that.
4. DCB Legal discontinue with single tickets. With £500 they may or may not. But even if the judge agrees you owe the ticket cost, the 3x £70 is a nonsense and in no way represent damages.

I'm not sure what you mean by the discontinue single ticket and £500?So if it goes to court and the judge agrees that I owe the ticket cost, how much would I end up paying all in?

You currently have one live court claim above, for 2 outstanding £100 pcns from Parking Eye via DCB Legal, spurious charges of £140 were added to the claim by dcb legal , 2 lots of £70 for debt collection, that never happened
Do not settle, their offers to settle are standard practice, IGNORE
Start a new thread about the other 2 that are at appeal or at LBCCC stages2 -

What should I do beyond this then? Can I end up paying loads in court fees etc?
