Excel Parking Charge Clarifications

Thanks to everyone that has pulled together the information on this forum. I've read a number of threads to try and understand my next steps.

As per the title, I've received a PCN from Excel Parking citing a contravention at The Walk Car Park in Ebbw Vale.

The PCN arrived 3 days ago with an issue date of 06/01/2025

The contravention reason is: Failure to purchase the parking tariff for the registration mark of the vehicle on site and/or within the time allowed.

The duration of stay is 12 minutes, and the Charge is £100.

I understand that the next step is to contact the land owner / retail store, which I will attempt to do in the next couple of days. I live 250 miles away from the retail park so I can't re-visit the site to gather evidence. From what I've read there is minimal signage at the site.

Assuming the land owner route is not successful, I'm looking to clarify if I need to tweak the appeal via the "One Size Fits All" template, do I need to drop the 3rd paragraph given no payments were made?

£100 for 12 minutes seems unreasonable, is querying that point via "not an accurate reflection of any loss suffered" statement also valid in this case?

Also, this PCN is issued to the "Keeper" and arrived outside of the 14 day window mentioned with regards to "POFA" (even the issue date is outside that window). I've tried to get my head around the "POFA" part of the newbie thread which hints as this being grounds to reject the charge, but comparing my letter vs the example Excel letters in the picture thread is proving difficult.

I've also read the keeper liability thread but I'm still a bit confused by the 14 days issue rule.

Any advice would be awesome

    Excel never use POFA 2012 so any 14 day rules dont apply to them because they are NOT invoking that 2012 law,  meaning no keeper liability   ( but possibly driver liability   )

    Excel follow the 6 months plus 1 month rules that apply anyway 

    The £100 charge is a typical charge figure and has been around for over a decade,  so no chance of arguing that its unreasonable,   £85 was considered by the Supreme Court 10 years ago,  as not unconscionable 

    Definitely complain to the retail park management company or business or landowner ASAP,  known as plan A

    Name the retail park and location or postcode 

    Ps,  Excel are not going to cancel the PCN,  regardless of the appeal wording

    I've spoke to Argos who were very unhelpful they couldn't even give me the name of the retail park management company. As above the, site is The Walk Car Park in Ebbw Vale NP23 6DL. I've not managed to dig up any info on who I can contact for the site, but have seen that a few people have appealed tickets at this site, not sure on the outcome though.

    Thanks @Coupon-mad is that because following the guidance the charge is eventually withdrawn? Or do people just not pay?

    You don't pay unless a judge says so,  in court,  if it ever gets that far

    Excel never cancel but cases are a cinch to see off in court, often without a hearing. Easier than any (waste of time) kangaroo court 'appeal'.

    Thanks, they phoned me back today but advised they would not be able to cancel the charge as there are "lots of parking signs at the property"
