EBay not received

I bought an item from eBay which I did not receive.
The seller posted it with verification and it has a tracking number. I think it was left either in my drive or in the wheelie bin ( very common). If it has been taken, what are my rights? Does the seller have to refund because they left it in an unsafe place? Or am I stuffed because they have a tracking number?

basically though you need to keep the seller on your side to assist you, if you try opening an INR you will lose if seller has delivery confirmation to your address, but with their help this might be possible to resolve.

first thing to do is ask your postman -delivery driver even better as they take photosif they have delivered it by mistake to the wrong address more and likley they will recognise the house from the photo and be able to track it down for you.they should not have left it by your door for others to see unless that is where you tell them thats your designated safe space.1

And even though there was 'proof of delivery', it wasn't my door and they accepted my photo of my door.
As it wasn't either of our fault, I would have been happy to split the value of the order but they just refunded in full.

You may to support your case need to make a denial of receipt to Royal Mail, or who ever the carrier was.0

In that case, track the item on Evri's website and get the photo of it left outside the house. Their 'evidence' actually works for you as it shows that the item was left outside the house, so upload it to the case. I have had to do this on two occasions now, where items were stolen from my front doorstep (in full view of the road), and won both cases. Whether or not the tracking has been updated as 'delivered' is irrelevant.

Technically no but a business seller will more likely work hard to protect their reputation.
My youngest is a business seller and my partner sold something privately, Evri delivered it and had photo's to prove it. No one wanted to assist and my partner waited it out, Ebay found in her favour and if any refund did occur it was via Ebay not her, Ebay also stated any negative feedback will be removed.
So if the seller has full tracking and enough info they could well find in the sellers favour.0
