It's not as straight forward as just claiming CA. They must have also worked and paid or treated as having paid class 1 or class 2 NI contribution in any tax year. For ESA a certain amount of NI credits must be from work - usually it's from within the last two full tax years but for people who've claimed CA just before applying for ESA there is a relaxation of that contribution condition, the credits from work can be from any tax year. And having claimed CA, that will have given her the NI credits she needs in the previous two tax yearshousebuyer143 said:

The assessment is then to determine whether she can continue claiming ESA and if so, at what rate.
If found fit for work her ESA would stop and she'd then have to look at claiming JSA;
If found to have limited capability for work she'd be put into the Work-Related Activity Group, probably need to attend appointments and do some work-related activity (subject to any restrictions due to bereavement - I'm not very familiar with ESA in this respect) and her ESA would end after a year; or
If found to have limited capability for work and work-related activity she'd be put into the Support Group, have no appointments or expectations, and her ESA would continue indefinitely until/unless she's later reassessed as no longer meeting the criteria for being in the Support Group.2 -

She will be claiming more under the mental health side of things, due to suffering anxiety attacks as my dad died suddenly and she had to do CPR etc, depressive outbursts, inability to deal with any stress or unplanned changes etc. if they put her in a workplace she would just fall apart.
I am certain she will get the fit note, so hopefully she can get through the assessment.0 -

Did your father cash in all his pensions or will some still pay a widow's pension? Did he have any pension funds remaining?0

Hi. I was in a similar circumstance. I moved from Carer's Allowance to new style ESA and when I claimed they declined it from checking the relevant tax years. I rang and explained I was in receipt of Carer's Allowance previously and the claim was then awarded. I'm not sure if someone has to override something to award the benefit in these circumstances.
