14-day cooling off period online shopping from Germany

I bought a book from an online shop in Germany which I want to return for a refund. I think I can as there’s a 14-day cooling off period for online shopping in UK and EU law. They are saying I can’t because since Brexit this rule doesn’t apply to the UK. Who’s right?

  • I would assume the seller says German law applies in which case yes I believe right to cancel exists regardless of being in another country or Brexit (but happy to be corrected), enforcing this is probably going to be difficult if they won’t agree.

What terms and conditions did you make the purchase under?

Even if they're not right and don't want to accept it back - trying to enforce it in anyway may be really hard. Also as it's "just a book" which was probably under.. £30? Is it worth it?

I've learnt it hard way not to buy online from abroad.
  • it was £100. Thinking of doing a chargeback on my debit card.

On what grounds?  I don't think change of mind will suffice.

There is no chargeback for change of mind.

If the book was £100.01 or more and you paid on a credit card then there would be Section 75 cover OP but no chargeback cover for change of mind.

Except again Change of mind is again not covered by S75.

Have to disagree. S75 is based on breach of contract or misrepresentation and if the change of mind is a term of the contract, implied or otherwise, or a representation to that effect, a claim under s75 will exist.
