Universal credit help

Hi, I'm new here and just hoping for a little advice please . I've wrote in our UC journal but not had any replies and I'm worried .

Our assessment dates are 28th-27th

My husband was paid on the 28th Nov, 5th dec, 12th dec all correctly ,then the 19th he was paid two wks pay due to Xmas so the 19th pay was for the 19th and 26th but this was just recorded to HMRC as the 19th. Not really a problem as he then wasn't getting paid again until the 2nd jan. So all in our assessment period and the right amount of wages for the month was recorded . But then his work decided to pay him his 2nd Jan pay on the 30th deç which again was ok because would have been in our next month's !!!!!! period until they recorded it as been paid on the 26 th Dec .  He actually got it the 30th and bank and payslip say 30th. So it now looks like he earned way to much in the assessment period. When infact he didn't . We've now received our UC for Jan and we're roughly about £450 down , I honestly don't know how we will manage . Spoke to payroll this morning who say they don't know how to change the dates in HMRC !! My understanding is that his payroll needs to contact HMRC and correct the dates . Can they refuse to do this ?? Once work have changed the dates with HMRC will UC amend our reward for the amount owing. ? If they don't and leave it as it is then next month it will also cause problems to because then it will look like he's not earned enough and not meeting the aet. So although in full time work he will get calls etc. I understand that there are months that are 5wks and we do save for these but this wasn't a 5wk month This isn't our fault and I'm worried sick it won't be sorted out. I'm reading that they will only move payments if you are paid monthly. Any advice I will greatly appreciate. Thankyou

  • I did also ask else where and a lovely lady told me to raise a RTI but I've been told by several people I can't do this as my husband's pay is weekly. ???

    Getting your husbands payroll to correct the pay dates is certainly the fastest way to achieve what you want. Them saying they don't know how to correct the pay dates is rather disturbing as it's their job to know. (They send a new FPS with the correct dates) If they do correct the pay dates then UC should receive the corrected information and recalculate your award.
    I suppose they could refuse (or claim not to know what they're doing)  but by sending incorrect information they are leaving the employer open to a penalty from HMRC for sending incorrect RTI date. It is possible to raise an RTI dispute with DWP but this will take longer to sort things out as DWP will need to check with HMRC who will need to check with your husbands employer.

    It's disappointing when employers do this and they are usually unaware of the problems it can cause for people when claiming UC. Also some people are quite private and would rather their employer didn't know they claimed UC. If they have to raise this issue it can be difficult, if not impossible, to do so without explaining why/
