new DCB LEGAL LOC received 02 December.

no actual claim received yet, is it too late for the keeper to name the driver?

    as in would an email being sent now not count as it is outside the 30 days

    Why do you want to throw someone under the bus in a DCB Legal issued claim? Let them issue the claim, defend it and they will discontinue some time later this year.

    you didn't answer my question? its none of your business why i want to throw someone under the bus, but whilst we're at it, im following previous advice on this very website about this very same issue regarding someone being better placed to defend. but thanks for your contribution.

    You can name the driver at any point up until a court claim is issued. 

    You may wish to do this if your spouse wants to pay and you're more clued up, for example.

    Email DCB Legal and the Euro Car Parks keeper liability email with the driver's name
    and address and instruct them both to ERASE all the keeper's current details. 

    Come back here if they kick off and lie about the 28 days timescale, which is NOT a liability transfer window as they sometimes like to make out.

    All being well the driver should receive a Notice to Driver in the post from ECP.

    And delete the reference number from your post because they could theoretically make a claim against the keeper this evening now they know who you are!

    The following, commissioned by the BPA themselves, using a law firm that appears to be BPA-sympathetic, might help you look at the possible legal position for when transfer of liability can be made prior to the 'commencement of proceedings'.
