Called Uxbridge County Court earlier today to obtain email address, to send witness statement to. Customer service told me there will be no hearing, as case has been withdrawn by Claimant. It seems DCB Legal / UK Parking Control are too cheap to pay that £27 court fee! They were asking me to pay £265.80.

Customer service also confirmed this withdrawal happened on the 11th of July and an order confirming this, should be sent to my address in the next few days.  :)

As there is still nothing official / in writing, regarding withdrawal, just yet; and witness statement deadline is tomorrow, I have gone ahead and emailed statement to Uxbridge county court and copied DCL legal. This is to cover all bases, in case hearing does go ahead, by any chance.

@Coupon-mad / @Gr1pr / @KeithP, Wil be good to hear your thoughts. Thank you for your support during this journey. I have learnt a lot  <3

Also can I still put in a claim for my costs, even if the case is withdrawn?

    Yay!

    ANOTHER ONE BITES THE DUST!

Please show us the Order when it arrives.

Or find the NoD email in your junk emails perhaps? We need to see the proof of Discontinuance (the NoD, not the email) to count your success.

Your other question (re costs) is already answered in the NEWBIES thread ... with two examples in a section that I'm frustrated that nobody ever seems to read...!

My apologies @Coupon-mad, I'll give that a read and share discontinuance when it arrives.

Hmmm... is this a new aspect of the scammery, I wonder?

You say the court knew the case was discontinued on 11th July but DCB Legal only dated your copy NoD last week.

Suggests to me that they MIGHT be deliberately delaying NoDs for Defendants (we've seen quite a few cases recently whose NoDs haven't arrived yet even though the courts confirm that the case is discontinued).

One wonders if they are seeing people panic and pay them in this time gap - payments which they wouldn't decline - so they are maybe routinely delaying Defendants' NoDs for a fortnight now?

If so, flipping heck they are the lowest of the low. Steve Clark - if I'm right - are you proud?

    Anyway congrats!  :D

    And now, we need you:

It's very important that people like you and the Defendant please join us to reply to the new Public Consultation, to tell the Government that:

    a) you have no faith in POPLA or the IAS and that there must be the SINGLE APPEALS SERVICE that the Parking (Code of Practice) Act 2019 promised the public. As long as it is independent (and only ONE appeals service, not two involved in a race to the bottom) that will give a real option to resolve disputed cases out of court. This could all have been avoided.

b).  THAT THE ENRICHMENT OF 'DEBT RECOVERY FEES' MUST BE COMPLETELY BANNED. DISPUTED CASES ARE NOT SOLVED BY A THIRD PARTY DEMANDING MORE MONEY AND OFFERING A 'PAYMENT PLAN' WHICH SHOULDN'T COST MORE MONEY. THE FCA BANS EXTRA COSTS FOR 'PAY-IN-THREE' PLANS IN ALL OTHER SECTORS, SO WHY IS THIS LEGAL IN A 'MARKET FAILURE' INDUSTRY THAT'S BEEN RINSING MILLIONS?

c). Tell them about your experience and that your case reached court hearing stage, precisely because (a) and (b) above mean there is no option, no safeguard for consumers EXCEPT to defend court claims and get proper dispute resolution and/or discontinuance.

Responses are invited to the Consultation now:

Do it in August pleeease! We will discuss it all in more detail in the coming weeks on that thread so do come back in a fortnight.

Thank you @Tyro123_2 for the copy of your NoD. I can now get this counted in the DCBL Legal thread of shame. 👍
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
