On the two occasions I have contacted an eBay seller in China about an item not arriving by the stated date they have immediately refunded me. Admittedly both were low value items.
When the items did eventually arrive (a few days for one but many weeks for the other) I duly contacted the sellers but was told to keep them as "goodwill".0 -
hmm if ebay produce a return label.sufficient to return to China it will be a first !

I don't think eBay does for international orders but if they did, in any situation where the label is insufficient, the buyer can contact customer services who will put the case on hold and instruct the seller to provide a correct shipping label (failure to do so results in a refund without return).Olinda99 said:

If the item arrives past the ETA (which is made up of the seller's handling time, the shipping service and any "dynamic" info eBay throws in) then the buyer can open a Not As Described return and the seller has to accept it.
If this were a UK seller Delivery of Goods comes in to play and whilst there is usually a second change for the trader if it s implicit from the circumstances time of delivery was essential* then the consumer may treat the contract at an end without giving a second chance for delivery, so the suggestion of not wanting to accept late delivery isn't outrageous regardless.
Obviously doesn't apply to sellers in China but if eBay policy is offering similar then either that is that or don't sell on eBay.
*I don't think ordering something in Dec makes it obvious it's for Xmas but a note on Checkout or the addition of a gift note where available may be as viewed as being obvious.In the game of chess you can never let your adversary see your pieces0 -
OP when was the ETA window? If it was entirely before Xmas then I would just raise it with eBay. If it was from before Xmas to after Xmas (and arrives in that time) then I think that’s on you.In any case, as others have said it’s not wise to refuse the delivery. It’ll get lost in the ether and then it’s just an uphill battle to get the refund. Just accept it, and offer to retain it until they sort out a refund.1

Exactly the same happened to me. I ordered some earrings in shape of lit up Christmas trees. I got an email from the seller in China saying the earrings had been “lost in the post” and they would refund my money. The earrings turned up in the New Year. I contacted them and they said I could keep them.
