Just a couple of notes.
1- "Under paragraph 9(2)(f), the NtK must include the following wording". The wording has changed.
2- "Paragraph 7 of the BPA CoP defines the mandatory requirements" this has disappeared in the newest BA CoP!
Thank you LukasBB for posting your appeal, this will help me and many others.0 -
What wording has changed? The POFA sch4 has never been updated or changed.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Also thanks from me to @LukasBB (and @sdg213) for recent Horizon posts. Complete newbie until a local Tesco sneakily reduced maximum stay. Why Tesco want to lose my custom for life, my 4 mobile phone contracts and insurance is beyond me but hey-ho. My eyes have been opened about this PPC scamming business thanks to you all here.
(I got sympathy in store for Plan A but little other engagement; Horizon (of course) rejected appeal and lied that NtK was PoFA compliant and signage was compliant with BPA/IPC code (it wasn't). Anyway, a crib of your appeal, plus a small extra section (as there is more than one Tesco in town and Horizon didn't specify which one) was submitted to POPLA on Saturday evening and I got the withdrawal eMail this morning (Monday)!
So, as I say, many thanks to all here, particularly the OP of this thread.2 -

Please add this success to POPLA Decisions with a copy of your appeal that worked v Horizon. That'll pay it forward to yet more people!

The POFA sch4 has never been updated or changed."The notice must state that the creditor does not know both the name of the driver and a current address for service for the driver and invite the keeper to pay the unpaid parking charges or, if the keeper was not the driver of the vehicle, to provide the name of the driver and a current address for service for the driver and to pass the notice on to the driver."It must also state:"(i) that the creditor will (if all the applicable conditions under this Schedule are met) have the right to recover from the keeper so much of that amount as remains unpaid; and(ii) the period of 28 days beginning with the day after that on which the notice is given."
POFA:
"9 (2)The notice must-
(f)warn the keeper that if, after the period of 28 days beginning with the day after that on which the notice is given—(i)the amount of the unpaid parking charges specified under paragraph (d) has not been paid in full, and(ii)the creditor does not know both the name of the driver and a current address for service for the driver, the creditor will (if all the applicable conditions under this Schedule are met) have the right to recover from the keeper so much of that amount as remains unpaid;"0 -
