Returning an order - no reply from retailer

    OK, so not Distance Selling Regs compliant then.
    i assume my credit card won’t be interested because i have received the item I just no longer want it.
    It's less than £100 so not enough for Section 75, but you might want to try a chargeback? Explain that you have tried to exercise your DSR rights but the seller in uncooperative?

  • My money is on this being a Chinese retailer, one of the payment methods (Union Pay) is a Chinese state owned financial organisation.

    It's the statutory right to cancel under The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013

    To be fair we don't (yet) know what regulations.

    We don't know because we don't know where in the world the seller is or what the contract of sale says. It could be somewhere in the UK of course.

    The checkout page has a link to some ‘terms of service’ in the footer. It (surprisingly) includes:

    9. Governing Law

    These Terms shall be governed and construed in accordance with the laws of England and Wales. You agree that any legal action or proceeding between you and Cue-King for any purpose concerning these Terms or the parties' obligations hereunder shall be brought exclusively in a court of competent jurisdiction sitting in England and Wales.

  • Interesting. Do I send them one last message and say that they are breaching the consumer contract and that I will envoke a chargeback with the bank if I don’t hear back or just go straight for the chargeback?

    One other thing I noticed is that they mention info@cueking.com (without hyphen) as the email address in most places, when the website is cue-king.com.
    The contact link on the checkout page has info@cue-king.com (with hyphen) though. Given cueking.com is a completely different website, I doubt the email address without the hyphen is the right one. Have you tried the email address with the hyphen?

  • Yeah that’s the one I’ve been using. That’s the one at the bottom of the  automated shopify email I got when I first requested the return

    Chargeback do not cover DSR & change of mind has never been a option.

    So today they replied to an email I sent about three weeks ago and asked for the order number and said they would send a returns label. 

    The punch in the face is that the order number was in the SUBJECT OF THE EMAIL. I think they are just trolling me at this point.

    i have replied. I don’t expect a response.
