Identity fraud

Someone is using my details to get credit. They have been ordering items online but not paying. I contacted the police,they say it is not against the law to use someone's details in scotland. Police told me that nobody can make me pay as the dont have my bank details. I have contacted the company to tell them about the identity fraud, I have list count on how many times I have phoned them. but I keep getting emails to make the payments. What should I do as this is on my credit score.

    To start with, you need to formally dispute the fake account in writing, who is the company?  Are the items being delivered to your name but at a different address?

    I used to get emails about a credit agreement for someone with the same name as me - turned out that the company had mis-input the email address details so I got all the correspondence but it was a genuine mistake.

    Can you provide more details of what you are getting etc?
  • The have my full name, full address , date of birth and my email address. 
    It's a company called zilch.  I don't know what name the items are being delivered to but it is not my address they are being delivered too. I have asked the company to check the delivery address but nobody gets back to me.

    I would expect Zilch to have a credit agreement that's backed up with a bank account or card - have you checked with your bank that no credit agreements are set up with them?

    To have all those details is strange - could it be a relative or someone who has access to your house?

    Zilch also have a live chat option - are you able to use that?
  • I think it is an ex of my son's but Iam not 100%  He thinks it is her also. At the beginning they paid a couple of payments and even received a refund. But nothing has came of my bank account or I never received the refund.

    So, perhaps they used your details as they could not get credit themselves - you could try a Subject Access Request with Zilch - at least that may start them taking you seriously.

    Can't you go to the login screen - and ask for a password reset?

    The email link should go to your email address?
