    As they are unlawfully threatening keeper liability in Scotland, you must make a complaint about this to the DVLA. PPCs have been banned from getting keeper details for doing that in the past. Such a complaint might cause it to happen again, but as a minimum, might force CPM to get off your back. 

    Complaints go to:

    ccrt@dvla.gov.uk and

    KADOEservice.support@dvla.gov.uk 

    Send the same complaint to both. 

    EDIT TO ADD - at a quick glance, it looks that Marchburn Drive is airport land, subject to byelaws, which again means that keeper liability isn't possible, so double up on that in your DVLA complaint. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Hello, I am writing to complain about the company UK-CPM who have sent mail in an unlawful and threatening manner.


    My understanding is PPC’s have been banned from getting keeper details in the past and letters such as they sent should never have been sent.


    I am extremely disappointed at the way these companies operate and harass people and would like you to contact this company so that no further letters are sent regarding this matter.

    Formal letters (of complaint) should start "Dear Sir" and end "yours faithfully". You also need to read what @Umkomaas wrote and add the bit about threatening keeper liability.

    1-  Does this reply fit the bill or does this invite more trouble?

    2- If I send a copy of the 2 “Parking notices” to these email addresses will that be detrimental? Should I not bother?

    - Due to the Protection of Freedoms Act not applying in Scotland and Northern Ireland, instead only the law of contract applies when managing parking on private land

    - No Keeper Liability: In Scotland, since PoFA does not apply, parking companies cannot pursue the registered keeper of the vehicle unless they can prove who was driving at the time of the alleged parking breach. If the driver is not identified, they have no legal right to demand payment from the registered keeper.

    Hi- so I I have heard back from the DVLA. It appears that both charges need to be paid?

    Thoughts? I have asked for clarification of who the landowner is?

    And no of course you dont pay.  I really can not get my head round people thinking they need to pay these things.  To many people are quite happy to go in to give up mode.

    Nothing has changed. This complaint was never intended to kill it off.

    Stop looking for next steps. Do nothing. Just ignore UKCPM in Scotland.
