C.U.P Parking Enforcement charge. Is it worth appealing?

    @Gloglow1 Hi, sorry, it's first time I've logged on here for a while. 

    The situation now is that C.U.P. have passed the parking charge fee onto a debt collection agency now asking for £160. 

    I've just ignored them, and have recently received a letter saying they're going to advise C.U.P. to take legal action. I'm hoping if it did get to the court stage it would get thrown out (as I know there's been another case on here at the exact same spot which the judge threw out instantly!). 

    I haven't tried my MP, that could be worth a try to be honest. I did email Argos/Sainsbury's as the passenger I dropped off was headed into there to collect something and we could prove it with the receipts, but as it's outside of their car park they couldn't act.

    Part of me thinks should I have just paid the £60 and avoided the hassle, but then that would mean C.U.P. have won and I'm being stubborn and refusing to pay because I strongly believe I wasn't actually in the wrong (or even parked!).

    It's very important that people like you - struggling with the threat of an aggressive court claim for no justified reason and with nowhere else to turn for a fair ADR - tell the Government that:

    a) you have no faith in POPLA or the IAS and that there must be the SINGLE APPEALS SERVICE that the Parking (Code of Practice) Act 2019 *almost* promised. That will give a real option to resolve disputed cases out of court.

    b).  THAT THE ENRICHMENT OF 'DEBT RECOVERY FEES' MUST BE COMPLETELY BANNED. DISPUTED CASES ARE NOT SOLVED BY DEMANDING MORE MONEY. THERE IS NO SEMBLANCE OF GENUINE 'DISPUTE RESOLUTION' ON OFFER FROM THE OPERATORS OR DRAs (attach pics if the £160 threatograms).

    c). Tell them about your experience and briefly about your case. But mainly we need the added 'fees' completely banned. And a fair Appeals Service.

    We will discuss it on that thread further next week. Please bookmark it and come back for more focus on the Government's questions.

    I have today received a Claim Form from DCB Legal LTD acting on behalf of Close Unit Protection (C.U.P). They're trying to say the amount owed is now £255.44 with added interest, court fees, and representatives costs.

    I'm guessing I just fill it out disputing the whole claim.

    There is no clear demarcation between the "managed" area and the public highway. 

    Normally double yellow lines enforce restrictions between the centre line of the highway and the property boundary, which is usually the wall of the building. 

    If there was a contravention, it is a council matter (parked on double yellow lines) and enforcement should be by a traffic warden or civil enforcement officer.

    Do let me know if you get a claim.
