New Car issues

Can anyone please advise on this.

We purchased a new Peugeot 5008 on PCP last October and 48 hours later it broke down and had to be towed back to the garage.  Long story short, it took Peugeot and the dealer 2 months to agree a new gearbox was needed.  In hindsight we should have rejected the car but instead agreed to take it back.  All was well until 5th August when the gearbox started grinding.  It went back to the dealer on 14th and they said it needed another gearbox.  On the same day I e mailed the dealer, finance company and Peugeot complaint team to reject the car.  Peugeot basically said its not their problem, I got an automatic reply from the finance company, and after multiple calls the dealership agreed to look into getting us a new car.

I have been in regular touch with the dealership, and have reminded them that the contract we have is with them, not Peugeot, but four months on we still haven't got a new car as they want Peugeot to fund the losses they will incur.

I have e mailed the finance company a total of five times, including one to ask them to act under section 75 of the Consumer Credit Act.  Each time I get an automated response with a reference number, but never had any other contact from them, except last week when they called and said they had just found my complaint!  They were very off and basically assumed it was all sorted.

Hopefully, we will have a new car in the new year as I have received e mails to suggest the dealership have requested a settlement figure.

What I want to know is can I ask for a refund/partial refund of the PCP payments from the dealership or finance company:

My rationale for this is:

- although we were eventually given a courtesy car it has always been of a lower spec than the 5008 we purchased i.e 3008
- we needed a 7 seater but have only been given a 5 seater which has caused issues
- the courtesy car was switched a month ago and replaced with an electric vehicle ( it was that or a smaller car) - its costing a fortune to charge the car up as we can't charge at home.  The original car was a hybrid so there is a significant increase in charging costs, not to mention the inconvenience of sitting at a charger for a couple of hours most weeks.

My priority is to get a new car, but are we being unreasonable asking for a refund of the PCP payments we have been paying for a car that has been off the road for 6-7 months out of the last 12?

    Is this a brand new car?

    Most warranties do not provide for a temp car, that is down to the dealer.
    What you need compared to what you got does not really matter. !!!!!! they may not have a 7 seater as a loan car.

  • Yes it was brand new in Oct 23
  • So its acceptable to pay for a car each month that has been undriveable as its been sitting with the dealership?

    Time to act would have been back in 2023 when it happened & you could have rejected the car at that point.
    Any rejection would have been with the dealer. So it would have been a case of not letting them fob you off. Manufacture has nothing to do with it.
    Finance would be looking at a S75 claim. Again if they did not agree, you complain & if not resolved you take it to FOS.

    So what are you actually wanting out of this?

  • Thanks for your response - like I said we should have rejected the car straight away, but with a Peugeot technical team involved as it was a new model we thought we had made the right decisions.  My post makes it clear what I want advice on - thanks

    I'm not sure that S75 would be possible, the base cost of a 5008 now is £38K, and while it might have been lower a year ago I suspect it was probably more than £30K.

    As finance then could be S75A, again depending on the cost 👍
