IHT forms

Good morning,
Could someone advise which forms I need to fill in regarding inheritance tax on behalf of my partner,
His father recently passed, who owned a house and a good some of money, my partner is an only child, by our calculations there is no inheritance tax to pay when using NRB,
obviously we need to apply for probate,
Would rather deal with this ourselves than get a solicitor involved,
I'm half way through the IHT400 form... but have read conflicting advice if it needs completing or not as there is no inheritance tax to pay,

  • You will generally only need to complete a full IHT return if you need to claim the residential NRB. So if his estate was below £325k it won’t be needed and if he was a widower up to £650k with the transferable NRB.

Your partner needs to be aware of what this inheritance means to his potential IHT liability if the two of you are not married.
  • Thank you for your response,
I will continue completing the IHT400 form along with all the additional forms 🙈
Yes his father was a widower,
Does he need to claim the unused nil tax band along side the residence nil tax band?

The estate value is less than 400k,

My partner is aware of his own IHT liabilities, more so recently, thanks 😊

You don’t need to do an IHT return where the entire estate can be covered by the NRB and any available transferable NRB from a deceased spouse.

All that should be required is to apply for probate (or letters of administration if there was no will))

  • OP, sounds like the deceased's estate is an excepted estate, but do use the online checker tool to confirm, as a few things such as lifetime gifts need to be considered.

I’m completing a PA1P for an excepted estate.  Do I need to use any kind of IHT form, either online to HMRC or paper to advise the HMRC.   It’s confusing as the Probate pack includes the IHT forms but says since 2021 they are no longer relevant.   Deceased died this year and I cannot find anything relevant to 2024.   Thanks for any assistance.
