DLA back payment and UC question

Good morning,

I woke up this morning to a large payment from DLA (we’ve been waiting 19+ weeks and although I’m not sure of the rates) but wanted to ask if this back pay contributes to my UC capital please? It’s child DLA if that makes a difference.

I’ll also need to ask for UC to back pay the disability element but I’m unsure whether or not to apply for the carers element - I think looking at the sum it’s MRC so I think I’d be entitled but Im unsure if this impacts my total UC claim? I work part time, earning approx £1400 a month net and get a small
reduction in council tax benefit as well as single person council tax benefit.

    The back pay will be disregarded from your UC capital calculation for one year.

    Carers Element won't effect your UC other than you now being entitled to more money.

    Once you've also received the backdated child disability element & carers element I would contact your local council in case those sums have an impact on your council tax reduction. Your single person discount won't be effected. 

    Each local council has different rules so it's hard to advise around on here.

    If your UC includes the LCWRA element for yourself then you will not be able to claim carers element at the same time. This is because the same person can’t receive both elements.

    Hi there and thank you. I don’t claim LCWRA, I just get UC for myself and extra for my two children but the DLA claim is for my son who is 6 and so it looks like I can claim the carers element. I think I’ll wait until I get my formal letter from DLA to update my journal, just so I can have all the info in front of me.

    As this is Child DLA then any backdated DLA is the childs money, so should not be counted as being the parents capital.
    It's probably best to put it, and the ongoing DLA payments, in a seperate bank account to make that distinction clear.
    However any backpayment now due of UC Disabled Child Element (and Carer Element) will be the parents money, so will be counted as the parents capital but disregarded for 12 months.
