How long to wait before starting Charge Back / Section 75 ??

I searched for a holiday ocean front King room  via Google , the usual booking company's come up with a few a lot cheaper ( non refundable ). I booked it ,the email front page confirmed "Ocean front King room " but when you open the attached Hotel Voucher it states "standard King room".
I emailed the company and to my surprise they did reply saying they will look into it with their suppliers.
Its been 5 days If I don't get a satisfactory out come how long do i wait until i get the credit card company involved. And would it be charge back or section 75

    Do you mean something like this...
    • You booked/bought a hotel room through a booking website - and you're not sure if a "Standard King Room" is the same as an "Ocean Front King Room" (because you booked an "Ocean Front King Room")
    • You've asked the booking website about it. They've said they'll contact the hotel (their supplier) to ask - but you haven't had an answer after 5 days
    • You haven't stayed at the hotel yet.

    If so, it might be better to phone (or email) the hotel and ask about the room.

    You'll probably get a much better level of customer service from a hotel than from an internet booking service.





    Or, for example, do you mean there 2 options when you booked, something like this:
    • Ocean front King Room for £x
    • Standard King Room for £y

    And you chose and paid for the more expensive "Ocean front King Room"?

  • Who did you actually book it through, if booking.com for example you may not have S75 rights.

    In reality you can not do anything till you get there & find out exactly what you are given.

    One reason that booking direct, while can be more expensive takes out issues like this, where it is just a play on words & descriptions on a 3rd party site.

    End of the day the hotel should be able to confirm what exactly you have booked.

    I emailed the Hotel and they replied immediately .They confirmed the reservation on their shows as a Standard, 1 King Bed and not an Ocean Front, 1 King Bed.
    I have the email and screenshot confirming my booking for a Ocean Front, 1 King Bed.
    Surly if  billabook.com dont refund me the credit card company can do something ??

    As you have booked through a 3rd party agent and not directly with the hotel, Sect 75 would be annulled.
    Your only hope maybe a chargeback, but whether you need to be provided with the service first is a point in question. Also this could  possibly be reversed by the supplier after the chargback as they could fall back to their t&c's. 
    Looking at the t&c's of the website you used, there are some horrible t&c's - not least it is governed by the law of the State of Israel. Some relevant terms below:

    Para 12,2 is a nice 'backside covering' term they might fall back on - ie not being responsible for any errors, mistakes or innaccuracies!

    Reading their Trustpilot reviews is a pretty mixed bag - often referring to not being able to contact them and not obtain refunds. 

    Try speaking to your card holder and see if they will carry out a chargeback. If they won't then you might end up chasing it up after the event via Israeli courts!

    They're an Israeli company which adds complexity given they dont work Fridays but do work Sundays but if you booked with a hotel outside of the Middle East then their central booking team more likely works mon-fri meaning there is only a 4 working day overlap. Your "5 days" there could be just 3 working days. 

    Most card issuers dont give you a choice between S75 or chargeback, you raise a dispute and they decide which of the two mechanisms to use. Normally they start with a chargeback because there is a much shorter time limit so you can do a chargeback followed by a S75 but rarely the other way around. 

    Given you've bought from an intermediary however it means S75 is likely off the table, for S75 you need to have paid the supplier directly, though it depends partially on who's fault the error is.


    When are you travelling? If months away then you can give them more time to resolve it. If it's weeks away then time could have more impact on the price of your rebooking.
