NHS blue badge parking

My friend has had a £60 fine from UKPC after an appointment in Leigh Infirmary. Husband has recently got the badge for mesothelioma and can hardly walk. She checked for restrictions on NHS & GOV  website. Both stated free parking for blue badge holders.Her appeal was rejected as the newly extended car park is apparently chargeable to everyone. Has anyone successfully appealed to POPLA as failure will result in £100 fine.? Thanks

    This is what it says on the Leigh Infirmary website about parking

    The Government has introduced new guidance on the provision of free car parking for certain groups of hospital patients and visitors. This means that the following people are now eligible to receive free parking at our hospitals:
    • Disabled people holding a valid Blue Badge, to be displayed in windscreen of vehicle.

    However, depends on when they parked and when the new rules were implemnted?

    Ideally, the patient complains about the PCN to PALS at the hospital ASAP, getting PALS to cancel it

    Your friend has not been fined, they have been sent a speculative invoice by UKPC.

    If your friend was displaying her husband's blue badge it would appear, from the above comment and the Leigh Infirmary website, that UKPC are trying it on.


    They should contact Leigh Infirmary PALS (Patient advice and liason services) and tell them to cancel this PCN for the reasons you stated, quote the information given on the Leigh Infirmary website. Don't take no for an answer.

    Their phone number is 01942 822376 although email or mail contact is preferable as you will have a written record of any dealings.

    Assuming that the appointment was for the hubby and not the friend herself. Otherwise it is misuse of the blue badge

    Not true, if her husband was with her.

    Clearly PALS must cancel this one and probably UKPC will cancel it once they see the Blue Badge in the first appeal. As a matter of consumer law & fairness, there cannot be one rule for one car park and another in the overflow one!

    There's nothing in the OP to say that hubby was even with her. It's a fairly common attitude to think that the blue badge can be used even if the holder is not present

    Whilst understanding that he may wish to, why would the husband - the blue badge holder - need to attend the appointment with his wife?

    You seem to be suggesting that a blue badge holder must actually get out of the car when parking and using their blue badge.
    Whilst it is highly likely that the badge holder would leave the car in most situations, is that really a necessity? Do 'the rules' say that?

    If the holder does not get out, there is no need to use the badge - and a parking fee should have been paid. The badge in that situation is only being used to evade a charge, not for the benefit of the holder.
