Non payment from Webuyanycar


Very new here and would appreciate any advice.
I sold my 2018 plate Mercedes
GLA 220 D 4MATIC AMG LINE PREMIUM to webuyanycar on Tuesday 26th Nov. Quick back story, I wanted a newer car as I had my car for 5 years and was in a very good condition. I was due to do a part exchange all the way in Aberdeen (I live in London and found a new car with good spec and low mileage). A week prior i was due to go up but heard a whistling sound from my car and the engine light appeared so I took it to Mercedes. They mentioned I would need to replace the exhaust flexi pipe so I prepaid for the part and had it booked in for a repair on Weds 27th Nov. Plan was to repair the part and make the journey up to Scotland straight after to get my new car the Friday. Audi Aberdeen suggested to see if I could sell the car down locally rather than doing a long drive up to then do it back down so I went online to get random quotes and booked an appointment for Tuesday with webuyanycar after the sent 3 separate emails with raising the price higher. Went with my mum to the appointment on Tuesday and I immediately notified the rep of the whistling sound and that the engine light was on and I had an appointment booked with Mercedes to replace the part. He told me "don't worry it's not a problem and we'll take it as it is". I had full service history, two keys, full mot history, car manual, practically everything. he quoted £12,100 (yes I know I would have gotten more privately but I'm a full time worker, single mother of two and my son is autistic and this week was the only week I had available to head up). I accepted the quote and happy days, or so I thought. (bearing in mind I did not expect to sell) I paid for next day payment, as same day was not available. The next day no payment so I called the branch. They told me my car showed outstanding finance. I told them that was incorrect and called my old finance company and they emailed them directly of the settlement letter. The branch manager then told me that the payment would reach me by 6pm. 6pm came no payment so I called back and he told me it should be there the next working day. Thursday came and still no payment, yet again I had to call the branch and the manager was now on AL and the staff member told me my car went for a second inspection with BCA. I said that was fine but my payment should be released. They told me they had to wait for the report. Friday came and still no emails or calls so I had to relentlessly hunt them down, took it to social media where I finally got a response. They mentioned someone would call me ASAP. That did not happen. Saturday I get a call from Chigwell branch stated that the secondary inspection had a fault due to the engine light and that there was a DPF issue and that either I accept £6,500 or come and collect the car. I absolutely refused this and contacted mecerdes straight away and they mentioned it is not a DPF issue and the car would just need a regeneration after the exhaust flexi pipe is repaired which is causing the issue. Tried calling back the webuyanycar branch and they were not answering calls. I had emailed a complaint and ready to do a letter before action. My worry is I do not want to take the car back as I don't know what may or may not have happened for 5 days since they've had it and also I declared and showed the rep everything and was very transparent with him on the day for him to tell me don't worry its fine. Mercedes have told me to take legal action and they are happy to provide their diagnostics and reports and confirmation of repair appointment. Has anyone had this issue. I am extremely angry and more importantly has made my journeys with my son to and from school difficult as I need a car for his needs. any advice would be helpful Thanks and apologies for the lengthy post however feel much better getting it out. |

I don’t have any advice to give.However I vowed never to use WBAC again after they disappointed me some years back.I went for an appointment’ to the nearest place 100 miles away. They kept me waiting for hours then offered me half the money previously agreed. The car was absolutely as I had described it for the online valuation, but they can offer whatever they like. Hubby persuaded me to accept rather than taking the car home as he’d driven down in his car to take us both home. It certainly left a bad taste and I’ve always regretted letting them have the car so cheaply.But they did pay - eventually. It took longer than it should but I hadn’t paid extra for a rapid payment.0

Reminds me of another thread on here, WBAG bought the car then refused to pay unless the seller took less money. The seller stood their ground (as advised from a few members) the seller threatened to take WBAG to court for non-payment. After a few weeks WBAC paid out fully.

Dear All,Apologies for the tiny text, I noticed it after. (new here)
I've been wrecking my brain, looking at various posts.
I did get contact from Audi Aberdeen mentioning they are willing to take the car as a part exchange still and offering their previous quote but I would need to fix the pipe.
My only issue is I do not want to take the car back from webuyanycar just incase something else has happened. I do not want to take that chance or be liable.
I do find it strange that I have not received any emails from the head office explaining the situation in writing.
I do feel apart of me refuses to back down and claim compensation on top.
My last complaint email on Saturday I did write the below: -Following the section on YOUR REPRESENTATIONS (from the terms and condition, every section was adhered to from my end especially me selling on a vehicle that any prudent purchaser would want to know).There is nothing stated on the contract that certain vehicles will be subject to a second inspection via BCA and these were not stated to myself at the time of purchase from your branch, manager and or rep.These were stated well after your company breached the contract themselves from not adhering to the next working day payment.0
