Recently had a telephone mediation appointment. Next stage Witness statement. The following is prep work.
I quote from my defence "4.At the material time, the vehicle was not at the location specified on the claimant's Notice to Keeper, nor that stated on the claim form. Proof that the vehicle was elsewhere at the material time will be provided at the evidence stage.  The claimant is put to strict proof that the contrary is true."
My question is that on Parkingeye's photograph it shows my car parked on my staff car park at 07.27am, leaving at 15.27pm on 30/10/23.
The times are incorrect as I never set off to work until 7,45 am and i travel 20 miles to get to the car park. I can produce a witness statement from a neighbour, who remembers my car being on the drive at 07.45 am on the morning in question. We had a long conversation on the Sunday evening and he remembers the clocks going back an hour which jogged his memory on the following morning.  Incidentally, the clocks went back an hour on the Sunday morning at 02.00 hours. I believe the Parkingeye camera clock had gone back 2 hours by mistake.
My wife can also deliver a witness statement to verify the same as my neighbour.
Sticking to the facts, my car was not parked up at that time and I have parked there for 10 years, never before 8.00 am but sometimes on another Parkingeye staff carpark. How will these 2 statements of evidence be perceived by a judge in court Thanks...

"the clocks going back an hour"

That's why the ANPR timings are wrong.

In your own WS point out that simple fact and attach your evidence and the other WS and say that you put ParkingEye to strict proof that they HAD adjusted and calibrated the clock(s) linked to the ANPR in/out cameras because on the balance of probabilities, clearly they had not!

Thanks for the above input. They had clearly not adjusted and calibrated the clock(s)correctly as their clock(s) had gone back 2 hours instead of 1 hour or had been adjusted and calibrated twice.by going back an hour each time.

    Exactly. State that.

They'll drop it when they realise.

Just a quick update. Today I received a General Form of Judgement, please see the attached letter. I think this is positive news. I would be grateful for your input.

It is definitely interesting,  especially the top date, it's a put up  ( in great detail  ) or shut up order to the claimants,  clearly that judge in Preston wasn't impressed,  similar to Judge Iyer in Manchester
