Hi I've finally received a court claim for a PCN which I dispute (its been going on for 2yrs now but the debt collectors just haven't given up). I've a few days left before I need to acknowledge service of the claim but I was hoping someone could look over my defence part 3 if I post here?. Everything else I'll copy from your template as needed, I just didn't want to get any of this wrong.

What is the Issue Date on your Claim Form?
Can you please show us a picture of the Particulars of Claim - with all your personal detail hidden of course.
Who is the Claimant?
Have you filed an Acknowledgment of Service?
If so, upon what date did you do so?
Your MCOL Claim History will have the definitive answer to that.2 -
Password is on show
Post your proposed paragraphs for 2 & 3 if using the standard defence template, not the rest
I suggest that you study recent ECP claims of a similar nature in order to draft those proposed paragraphs2 -

Hi Coupon-mad. I've looked at the post you mentioned but the defence rests on issues relating to the signage. I can't comment on that in my case so will need to rely on the lack of detail in the breach of contract for length of stay.0

With a Claim Issue Date of 21st November, you have until Tuesday 10th December to file an Acknowledgment of Service. Do not file an Acknowledgment of Service before 26th November, but otherwise there is nothing to be gained by delaying it.To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.
Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Tuesday 24th December 2024 to file a Defence. That's over four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute. To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.3 -

Please go back and read the advice I gave him/her and what they then added.
Or read any other DCB Legal claim defence this month.
